While the internet has mountains of garbage, it is still the largest (and most up to date) library in the world from which to do research. Do people like Delay and other stuck-in-the-past conservative traditionalists think you need an old-fashioned, officially published, 2 lb, perfect bound book from which to do research? It just shows his ignorance and inability to adapt to a changing world.

But if the common usage is "cool", then I guess I dig it. Hang on, gotta go tell my kid that somebody on the internet called me "cool". She'll never believe it, although all of her friends call me their "Second Daddy". Spring must be here, people are nicer....

You have been watching the Jackson trial too much.... My daughters girlfriends all report their grades to me. I started six or eight years ago asking them how they were doing. Now they all bring their report cards to the house and tell me what happened, and what colleges they want to go to...

Oh well... coming back to the original topic of the discussion... as I was explaining to a soon-to-be-back member, that I believe Delay's comments have less to do with what internet sites the Supreme Court judge is using for his research and more to do with the fundamental principle that a judge should base his decision on the evidence submitted in the trial and the statements made by the plaintiff and defence attorney as well as the witnesses. If the judge goes around doing their own research on the topic at hand, then this will potentially open up the case for more evidence than had been admitted. Ofcourse, a judge will always do research on legal issues involving precedence in a particular fact-pattern and previous decisions by the courts. Although I would imagine, either set of attorneys will bring all such information in front of the judge during the trial anyway.
I'd defer to the knowledge of someone who is familiar with the practice of law.

Faisal: I don’t know the context of the Delay quote or Kennedy’s quote. There is a difference between a Judge researching the “law” on his own and a Judge researching “facts” on their own. Appellate Judges are supposed to make decisions based upon a factual record that has been developed at the trial court level. Appellate Judges are not supposed to retry a case and develop new or different facts from those that were presented to the trial judge.
If Kennedy conducts internet research to learn facts about a case that never were presented to the trial court, then he is open to criticism. However, there are a broad array of sources of legal information available on the Internet. I research statutes and case law on the Internet quite frequently and welcome having judges who do legal research on their own, via the Internet or otherwise.
