Inorder to bring a defamatory claim against someone 4 things have to be established 
These are
- Existence of a defamatory statement
- Publication of the defamatory statement
- The statement must refer to the claimant
- Is it libel/slander?
(Libel: Defamatory expression is libellious if it takes a permanent form. Eg, writing, pictures, radio broadcasts
Slander: A more transient form of defamation. EG, spoken words, gestures or mimcry)
Defences available for a defamatory action: truth, fair comment, qualified and absolute privilege, statutory defences 
Do you think that the conditions are too narrow inorder to determine whether or not such a claim exists? Why?
