Regardless of how he is dressed or looks...he is technically a guy. If you ignore the clothes, is this person a man? If yes, he goes the men's bathroom. I think safety wise its also less of a risk if he uses the men's bathroom.

I heard of a company that built a special bathroom for transexuals or people like that. This was so female employees didn't complain about sexual harassment and violations of their privacy.
But not every company can do this? But what can you do esp' when you work in England where transexuals (or cross dressers) have rights and can sue you for discrimination if you complain?

well the firm will probably not stop the man because they dont want to face a discrimination lawsuit. on the other hand, if an incident like sexually assaulting a female coworker in the bathroom occurred, the female coworker can probably suit the firm too on ground that they dont have good safety rules/regulations enforced in the workplace.
it's a lose-lose situation for them. shouldnt have hired the guy in the first place and as a reason they could have written down something else in the file.
I am not sure what legal rights in terms of bathroom usage, do cross dresser have .. many places even have nursing stations within ladies room. So think if a lady is breast feeding her kid and a guy in a pink dress just walks in on her. What should be/would be her reaction

I dont think your employer will mess with that thing's "rights" (not sure whether to call it a man or a woman), nobody wants a discrimination lawsuit heading their way.
Morally - if the thing had the necessary morals, it would probably be fighting the desire to transform into something unidentifiable and not make others uncomfortable at work. Generally, the cross dressers stay 'normal' at the workplace and save the conversion for the late-night-freak-bars. They do understand that acting this way could significantly jeoperdize their social life and official interactions. If this one doesnt care about all those serious problems, merely making the ladies uncomfortable by using their bathroom would most likely be the last of its worries. Apparently this thing actually is misusing its given rights by squeezing the lemon standing up!
Having said that, women shouldnt be bothered too much about it. Yes this constitutes invasion of privacy but then this thing definitely isnt 'man enough' to be worried about. Although they could tell it, considering it one of their own (:p), to at least act decent in there. Without doubt this must be annoying for the women, but they should try to take it a bit light, if this thing considered itself a man, it would be acting VERY different and not be where it is today.
