I am not on holidays as such....I have decided to take a year out and live a life of leisure and do some travelling towards the end of this year.

Re: Contract

John Brown John Brown John Brown :dixsi:

by genuiness I assume you mean 'good faith'?

how about delivery? (or performance)...basically how are you going to receive it.

Genuineness means that there shouldn't be any misrepresentation.

Performance or delivery would be covered by the offer and acceptance.

What about misrepresentation/interpretation of the contract?
All I can remember from my 2 days law class is, there’s something about contractual theory. The professor was rambling in his monotonous voice, and I was busy learning how to revolve pen, around my fingers.. :woho: Oh lord…

Re: Contract

Misrepresentation is a ground for cancelling the contract. I guess if the parties disagree about the interpretation then the courts that have jurisdiction will interpret.

Some people like to include performance and delivery within the contract separately from offer and acceptance. Performance and delivery would state exactly HOW you would give and/or receive...it's more specific. Just an option...prevents misunderstandings and/or misinterpretations.
