please, i ask you to speak to a scholar an alima and see what they say someone with knowledge who is learned, inshAllah they will tell you whats right and whats wrong.. dont rely on a chat forum for islamic knowledge and advice.

Islamic knowledge can manifest itself in many forms, including direct quotes from Quran and links to reknowned Islamic scholars. To call the whole GupShup network a 'chat forum' is a bit of a misnomer.

Devoted2Allah - what are you afraid of? Many of the guppies here, mashallah se, are very well versed in religion - and all you need is a direct quotation from the Quran or the Hadith to confirm or deny something.
Or even a reference to a scholarly journal article. So chill. Who knows, I might be wrong in all of this. But I'd like to investigate it anyway.

And many aalims in Pakistan don't know what they're talking about - I've heard many bogus claims by aalims in Pakistan.
I dont trust Pakistani aalims as a good source for info.

I think there is a fiqh issue as to what will happen if the husband goes missing and how long has the wife to wait before she can remarry. It became news many years ago when the husband of a TV actress in Pakistan (screen name Bindiya) disappeared in Africa or someplace. He showed up 7 years later, and there were some ulemas who said that there is a 5 or 6 year limit after which the nikah is no longer valid. I can't remember the whole details now, but it is a fairly esoteric discussion.

i believe there must be some law along those lines waise. i know sistani mandates that the marriage be consummated atleast every four months unless theres certain conditions.. but i dont know if the marriage is annulled otherwise. there should be a sunni parallel to it.

And thus you see the light. I have standard policy of refusing to follow any Pakistani religious scholar. I look to the new generation of arab scholars instead.

It is pretty sad when we can dismiss some ones views, even though they might have spent a lifetime studying the subject. You guys do listen to your professors or school teachers...dont you? Why is that?
PCG, you can also get a degree without going to school...all you have to do is open a book, look up some information and take some exams.

There is no rule, as such. But sooner the better. Un-necessary delay is not allowed.
Means, if it is consensual, then its fine. If either one party is willing and other is not, then he/she is denying the right of spouse. Which is considered a sin as not fullfilling your duty as per marraige contract.
Just to make it clear, According to both fiqah’s (hanfia /ja’faria) Marraige does not terminate automatically in the above mentioned condition. The proper way (for a woman) is to contact court and get a divorce (after certain procedure) and If there is an Islamic court, it can decide( on the basis of avaiable info or investigation and trying to contact the person) to award Khula.
That khula (Islamic divorce authorised by Sharia court on request of woman) will be considered end of previous marraige contract and woman will be free to marry again after ida’t.
