Justice (Retd) Shah also politely took issue with the newly established “custom” of the Supreme Court’s top judges of declaring to the people on the street that “good news” (kush-khabri) was in the offing for the populace. Such a “predication” was first made in 1993 by the then chief justice, Mr Nasim Hasan Shah, before delivering the verdict on the dismissal of the Nawaz Sharif government. This time, too, a totally needless sop was thus offered to the greatly incensed lawyers’ community whose leader Mr Malik had first threatened to burn down the court in case of an adverse verdict but mercifully later withdrew his statement as a “slip of the tongue”. On the other hand, Mr Kurd has never stopped emphasising the “political” nature of the struggle being waged for the independence of the judiciary by the legal profession.
