musharraf's rule is not unconstitutional. after the coup, only those justices were retained on the superior courts who agreed to accept the p.c.o. the current cj is one of the judges who accepted the pco. the court granted musharraf two years to get the domestic house in order before holding elections. musharraf himself was elected under the referendum and 17th amendment permitted mush to hold dual offices until the end of this year. musharraf however gave an unwritten comittment to mma that he would take off his uniform after two years which he did not.

musharraf's rule has been challanged in the courts multiple times and each time court has ruled in favour of musharraf. question now is what the cj is going to do next time musharraf's rule is challanged. musharraf can legally seek vote from current assembly because his first election was through referendum. cj cant revoke musharraf's amendment to constitution because he swore on the quran that he accepted the change to the constitution which legalised musharraf's action against n.s.
