yes from cps, as well as psychiatrists (adult and child). along with police reports/incident reports and character witnesses.

And yes, it would require psychiatric evaluations as well as some witnesses that can testify seeing the woman being an unfit or irresponsible parent.

Islamically he can claim custody for a child who's past puberty I think, even if the mother doesn't fall into the catergories mentioned above.

The kids are not yet at that age and unfortunately he lives in the US so he has to go through the legal proceedings in the US courts.

Child custody (whether its sole or joint) is determined by what's in the best interest of the child, and whether or not one parent (or both) can provide a stable envionment for the minor. If the child is old enough to verbalize a preferance as to who they want to live with...the courts at times do take that into consideration. Each state also has their own "criteria" for custody...so the father in your question really should get together with a reputable attorney who specializes in custody and find out details on his specific state.
As for determining what's in the best interest of the child/stability, the courts usually take into account factors such as the parent's economic situation, past/present behavior as a parents, any criminal/mental health/abuse history, the child's "daily life" with the parent, how attached is the child to the parent etc. At times the courts may take into account negative habits of a parents such as smoking, gambling, drinking etc. if it can be proven that these habit (although not illegal) can have a negative effect on minor. If the 2 parents live in different cities or states, and the child is of school age, then the court also take into account how will the child react to being moved to a different enviornment (ie. how deeply is the child rooted in the current community in terms of being close to relatives that live nearby, friends, school activities etc.).
If one of the parent's insists on sole custody, and the other parents also wants sole(or joint) custody.......UNLESS one of the parents have undeniable proof that the other parent is incapable of providing a safe enviorment for the child....the custody battle can get VERY nasty and will require testimonies from friends, relatives, co-workers etc. In those situations, what details the parent can use as ammunition really should be best handled by the lawyer. When fighing for sole custody, the parent must be carefuly as to what perception the judge gets.....the parent/lawyer must give the impression that they're seeking sole custody ONLY b/c its in the best interest of the child....NOT out of revenge, to "punish" the other parent or any other selfish reason of their own(this happens more than people realize!).

I was asking , as I thought it might be that the father just wants to take them away from the mother more on the grounds of personal vengeance. Lol I blame my all-men-are-evil mentality for this.
