of course...the qaazii [shari'a Judge] can grant Khula even in his absence. for talaaq purposes, no witness is needed. a husband can divorce his wife even in the privacy.

thanks, but how will she go about it, she lives here in the uk. who does she go to, and also what about the stuff they gave her like gold etc and how does the husband get notification.

**that's a different story. i think in the west you have to follow the 'law of the land' and go thru the divorce process in a family court. the Judge will divide the assets.
islamically, i don't think you can go to a British court to get a Khula or talaaq. a man can divorce his wife anywhere but it won't be legal in the sight of the law of the land. i don't know how a woman can get a Khula in the west...that won't be legal anyway. i think the best way to go about it is to go to the Regular Court System and obtain a legal divorce.**

You have to find a Sheikh who will help you through the Islamic Khula. If you contact a local masjid, they can tell you who to talk to. In Chicago, the Shariah board helps with things like this. You'd have to provide her husband's contact information and they would try to get in touch with him to finalize the Khula. The notification is not your job. If he refuses to talk or is MIA, the Sheikh does grant a Khula but he has to make an effort to try to reach him.
The gold is a gift and you do not have to return it. If you want to, that is different but you do not have to.

because they make things as hard as possible! I had to go to the council to ask for Kulla from my ex...they ignored my first request even though i sent the fee a year later i had to write to them again, and then constantly call them until the process was finally started.

^ Difficult they are. Only when I threatened to turn up at their headquarters in my mini skirt did they answer my calls/letters. They will take your money while sitting around all day drinking their chai and calling everyone sister.

That's weird...I wasn't charged for mine. My mom made a donation after it was all done to the board but they never charged me anything before or after.

What's £300 if she gets the Khula. I say go with the Islamic Sharia Council route and keep on at them to do whatever it is they need to do to give your sister the khula. If need be, go down with the sister and a senior male member of the family to get them to hurry up if it is taking too long or you feel they aren't doing enough..
