can u overstay your visa in the u.s and get away with it?

I was in America in the mid 90’s on a student visa …back then a visit visa or studuent visa was just as good as green card as you could work there and overstay… and nobody was gonna come after you.

I want to know if thats still possible for someone who may wanna fly there on a visit visa…can you over stay your visa now in America and not get caught?.. as a Pakistani ofcourse,

If you overstay your visa, you'll end up in their database. Upon your next visit, you'll be immediately sent back on another flight.

USA is a big country. There's still tons of people here who are living "out of status". If you had over stayed and then went away and then if they give you another visa when you apply, chances are that you would be let in. Just be straight forward when you are questioned as they would know most of your history.

Why plan something that is not gonna do much good for you. I wont advise overstay in future. What u have done is done.

They do come after you and then they will post it in next day's paper another Pakistani was found hiding under the bushes....

They extend your visa when entering. The last time my visa was about to expire in a few weeks, and the guy just extended it by 2 months with a stamp and I didnt even ask him to, coz I was planning on returning. Luckily for me it turned out to be a blessing coz I ended up extending my stay.

thanks for the advice...I guess my American dream is pretty much dead now. I was in California for 6 years...will miss it.

Depends actually on your visa officer and how you define "get away with it". In your case, there is no harm in applying for a visa (visit.work/whatever) and see what they say. That you over-stayed back then is a black mark, but that you returned is also in their database. So its all kinda on the judgement of the visa officer to decide how much of an immigration risk you are. There are many other factors considered, ofcourse i.e. your job, academic status, family ties, financial position etc.

Its not that.I already have the us visit visa, but I've not gone back their since they started special registration at the airport.On a visit visa u can only stay there for 6 months or so by law.

I am wondering if I get registered there at the airport upon arrival then may be I should forget about staying in the u.s on long term basis as I would not be able to work there or overstay without getting caught.

Brother,
when u will go for visa, they will give u a handbook clearly marked that u will not be authorised to overstay the period allotted by the immigration officer on the port of entry and u will not be allotted the entry more than six weeks.
You will definitely be registered for INS, fotographed and finger printed, and u will be informed that it is your responsibility to get u r passport stamped wit exit and failing to do so will nat allow to re enter in usa and if u want to extend u r entry period , u need to apply local immigration officer in usa and provide the r eason for overstay and at the time of exit again they will take u r foto and finger print and stamp u r passport. Now u can make u r mind and decide what to do.
Thaye even register canadian citizens but for pakistani passport holders it is a must.

Oh, so you already have a visa stamped on your passport... pehlay batana thaa na, aisay hi waqt zaaya kiya.

Anyway, as anyone in the US will tell you, its a very bad/stupid idea to over-stay (or generally go Out of Status) in the United States, in the present circumstances. Unless, ofcourse, you are not uncomfortable with the thought of spending a few weeks/months/years in the slammer and then being deported.

If you have a valid reason to over-stay, you can easily extend your legal stay period in the US. Do everything according to the immigration law and the authorities will extend your stay without objection. I was in a similar situation in 2004. My stay period was expiring but I needed to stay in the US for an additional 3 weeks. I applied through INS for stay extension by using I-94 form. Once you apply for stay extension through this form and you get a return receipt from INS, you automatically become legal till the time your application is processed.

I, off course, departed before the expiry of my requested 3 weeks extension period, but I only received the approval of my stay extension 6 months after I had already left US. There is a long long que for applications.

Do inform them of any address change within 10 days of shifting.
