Why the respect of abiding law is drastically vanishing from the hearts of general public? Only because public has seen the ‘Mautee Plaeed” of the Law mostly through the hands of judiciary itself. People know from the very beginning the rich and elite never had respect for law as their influence and money is the supreme law. The ordinary mortals however generally had respect and fear of the law and the judiciary. Today seeing the army having been turned into a real state exchange, judiciary has lost more respect than the army. Today generally army is not respected, its fear has gone. 15-20 years ago no body could think kidnapping an army person or passing by a stationed army jeep on the road putting eyes to eyes to jawans sitting inside. Today even the educated people talk about Reeshwat in the higher courts and believe any decision can be obtained by sowing the right silver. Since our higher court judges like politicians issue orders over orders and please themselves when newspapers label those orders as land mark judgment. These judges but hardly see the their own judgments implemented. The judiciary attitude can be seen in case of Valima meal ban petition dismissed. A citizen Hanif Abbasi appeared in Supreme Court and drew the attention of the court towards violation of S.C marriage meal orders by influential people and of police The Court comprising Chief Justice Nazim Sidiqui, Mr. Justice Hameed Dogar, and Mr. Justice Tassadq told that legislation was the domain of the legislature and implementation of laws the duty of executive authority. The court has only restored the Federal Law of 2000. The judges said interpretation of law is court jourisdiction.. They said the S.C has only interrupted the law banning marriage meal. When Hanif Abbasi a citizen pleaded that court may taken note of violation by elite people as contempt of court the judges got angered and warned the ordinary citizen Abbasi that severe action could be taken if law and order of the court is not implemented. In other words asking the court to take action of violators was breaking the courts order by the citizen. The law was already there since 2000. If S.C had no power to see violation then what was the need of its refreshing the law and create of nation wide controversy. The court can take action against such a citizen but when it comes the question of rich people then point comes that it is the duty of Executive. On the other hand in India if a higher court gives any order on any public matter it also sees no body violates it. The column writer Javaid Chodwry in his article entitled ‘I shiver” in Jang Karachi on 30.12.2004 describes his attendance in a weeding party. He received an invitation to attend the marriage party at Lahore in a Hotel. The marriage ceremony as usual was late and Dinner was served at 03.00 am (mid night). According to Javaid Chodwry when he asked his host friend that there was a S.C ban on wedding meals the host replied that he was not giving “meal” but a “Dinner”. Can the S.C showing any courage in the larger interest of this country and in the larger interest of fear of the law summon Javaid Chodwy to identify the host of marriage party and then summon him, the hotel owner, the area police chief to know from them the difference between a meal and a dinner to at least show that our S.C sometime can become serious.
Re: Can S.C dare call column writer and then hotel owner, host and are S.H.O
Long post but some valid points ...
General perception is that laws and rules are for the weak and the poor
Judiciary is biased & corrupt and has lost its effectiveness
Laws that go against common sense and norms are hard to enforce
