The question is: Can your privacy and confidential records remain private after one passes away?
The reason i ask that is because there are news bites on the radio airwaves regarding Michael Jackson’s sudden death, and efforts are being made to locate Michael’s personal physician to see if there maybe clues to the kind of medication/treatment(s) he might have been on which could have triggered a cardiac arrest.
But what if, the deceased wanted that information to remain confidential. As is the case between you and your physician while you are alive.
What’s your say on it, should the records be made public to the fans and curious minds? Or should the physician withhold all such information (even at the cost of keeping the death a “mystery” to many) in accordance with the confidential bond that a Doctor and a Patient maintains…
Re: Can privacy remain private after death? Should it?
Ideally, one's private stuff should go six feet under with them and not be made public. Or some of it may be revealed to the relevant authorities if it was a matter of national interest.
if the deceased wanted them to be kept confidential then thats how they should remain. only the authorities concerned have the right to investigate. as for fan following and stuff, i find it unhealthy curiosity.
Re: Can privacy remain private after death? Should it?
There are way too many legal issues involved here to keep everything private. The death could have been (and sounds likely that it was) caused by improper use of prescription drugs. So the treating docs will be investigated and if cause is found, they will be prosecuted. The children....there is speculation tht MJ may (or may not) be the biological father. This too has to come out. If he was the father then the kids can more easily go to his parents. Otherwise, the biological mothers have more rights.
In USA, cause and manner of death are a matter of public record. And when you're as astoundingly famous as MJ, those records are of vital interest to the public.
Do I agree with this? Not really. But its all coming out one way or another since the custody of the children is at stake and the cause and manner of death - ie., whether or not his docs are prosecuted, will make the whole sad story a media sensation. Even if they seal his medical records, it will be a publicity scene if his doc(s) are arrested and prosecuted.
