That’s not correct.

Just as under western law, a marriage can be ended in either a divorce, or an annulment (khula).

Islamically, in a divorce, the dowry given to the woman is kept by the woman. In an annulment, the dowry is returned to the husband.

A man can unilaterally initiate a divorce, in which case the wife keeps the dowry. If we wants to retrieve the dowry, he has to petition a judge to grant an annulment instead.

A women can unilaterally initiate an annulment (khula), in which case she forfeits her right on the dowry. If she wants to keep the dowry but still end the marriage, she would have to petition a judge for a divorce.
