It is illegal to call someone a kafir, because one can never be sure whether he would die on Imaan and Islam or not.
However, there is an exception I am aware of that a person who fights/insults/hates Islam, Muslims in full awareness of correct Islam can be termed a kafir.
Kafir means disbeliever or a person who rejects the truth.
