If the Vice President and the President were out hunting together and the VP accidentally shot the P... and if a court deemed it to have been accidental, would the way be clear for the VP to become the P?

I can just imagine a history textbook in the future.... Mr X, the Vice-President, became the President after accidentally shooting his predecessor in the back of the head....
