Before someone jumps at me…please read the post as I am just wondering out loud.
When it comes to homosexuality…what is religious mandate in reality?
Is it the act of lewdness that is prohibited or is being homosexual (sexual orientation) prohibited? And how can the latter be prohibited if one is born that way?
^ Transgender or hermaphrodites are different than homosexuality.
No one is born gay.. sexuality emerges over time and is very complex... it's a mixture of environmental factors, nurturing and genetics. One can have a strong marker for being gay yet grow up straight or vice versa.
Same as every sin tho... u can think of drinking, but if u don't do it... it's not a sin.

Zina is a sin and I've heard that unjustified anger is haram too. Some people naturally have a stronger sex drive or a bad temper or something else or the other. But let's go with the argument that it's in the person's fitrat, then that in itself may not be bad but they would still have to control those urges, to not act them out in a way that's prohibited. Just my two cents; I could be totally wrong though.

Merely having an inclination may not be a sin but acting on that inclination certainly is.
