**Two MMA MPAs move BHC against acceptance of their resignations **
A division bench of the Balochistan High Court suspended on Wednesday the notification issued by the Balochistan Assembly speaker on Tuesday evening in which he accepted the “fake resignation” of Muttahida Majlis-e-Amal (MMA) MPA Amna Khanum. The bench also issued notices to the speaker, the Balochistan election commissioner, the Election Commission of Pakistan secretary, the Balochistan chief secretary, the Balochistan advocate-general and the deputy attorney-general for Pakistan for Oct 4.
The bench, comprising Chief Justice Amanullah Khan Yasinzai and Justice Akhtar Zaman Malghani, suspended the notification while acting on a “stay application” after preliminary hearing of a constitutional petition filed by Amna Khanum. The petitioner stated that she had not tendered her resignation rather her party leaders had submitted a resignation with forged signature on her letter pad. She said she informed Speaker Jamal Shah Kakar verbally and in writing, asking him not to accept the resignation on Tuesday, but he issued the notification of acceptance of her resignation and declared her seat as vacant because he (the speaker) had a leaning towards the Muttahida Majlis-e-Amal. She prayed to the court to suspend the notification and restrain the respondents from accepting her resignation. The matter will be taken up again for hearing on Thursday on an urgent basis. The bench will also hear on urgent basis another petition filed by Agha Faisal Dawood, challenging the notification of his resignation issued by the speaker. The petitioner submitted that he had not tendered his resignation from the assembly seat and informed the speaker not to accept his resignation letter. He prayed to the court to declare the notification null and void and restrain the respondents — the speaker, the Balochistan election commissioner, the Election Commission of Pakistan secretary and the Balochistan government — from accepting his resignation.
