Right, i just want to clear up an issue that i have. I come from AK (well actually my dad does, i was born in England) and always believed it to be a permanent part of Pakistan. However i had a discussion with my dad, and he says that it isnt and that it is technically possible for it to fall into Indian control.
I thought it was only Jammu & Kashmir that is disputed, and that this didnt include AK.
Can anyone clear this up. Im confused!

All of Kashmir is technically, according to the UN, internationally disputed territory.
The Pakistan constitution states that

There is no explicit mention of Kashmir in this definition. Azad Kashmir exists as an autonomous state under Pakistani administration, which is why Azad Kashmir has such a different governance structure to Pakistani provinces. For example, Azad Kashmir has its own President and Prime Minister, separate from the Presidence and Prime Minister's office of Pakistan.
It is also why until the Kargil conflict the Pakistani Army did not have any Kashmiri regiments in it. Until Kargil, the kashmiri Northern Light Infantry was a paramilitary formation. Only afterwards was it reclassified as a Pakistan Army unit.

A comparison to Azad Kashmir's position is Oman in the first half of the 20th century. Oman was an autonomous state, but was a British Protectorate. Britain was responsible for Oman's defence and international affairs, but Oman controlled its domestic policies.
Similarly, Pakistan represents Azad Kashmir internationally and is responsible for defending it, but Azad Kashmir sets its own domestic policies.

Well, the reasoning that i can see is if it is disputed territory then it doesnt belong to either side, and India have as much claim to it as Pakistan.
I dont claim to know much about what the situation is, and can only make assumptions according to what i have heard from other people.

Zapp, legally Kashmir should belong to either India or Pakistan - that was the basis of Partition of the subcontinent. This probably wont happen, and some solution will be worked out. But legally, according to the Instrument of Partition, the people of Kashmir have to vote either India or Pakistan still.
