By this analogy charge a murderer for murder, not for tax evasion.

it was a simple case of vandalism of a religious place. charge them for it.

See, followers of gods have always been tested through out the ages. their statues were broken by non believers, their religious places were destroyed, they were exiled, executed and ridiculed.
now a simple act of vandalism cannot hurt religious sentiments of people. It surely hurts ego, honour and your sense of security but no way it hurts religious sentiments.

laws should be preventive. Punishment comes at later stages.
