Asif & Shoiab face anti-doping appeal

**Pakistan faces anti-doping appeal **

Asif and Shoaib are set to resume their careers in domestic cricket
The World Anti-Doping Agency has filed an appeal against the lifting of bans on Pakistan fast bowlers Shoaib Akhtar and Mohammad Asif.
The case will now be heard by the Court of Arbitration for Sport in Lausanne.

Wada spokesman Frederic Donze said the action was being taken “in the interest of doping-free sport” and the “uniform application” of its code in all sports.

Pakistan Cricket Board chairman Dr Naseem Ashraf has insisted, however, that the matter is now closed.

Shoaib was originally banned for two years and his younger team-mate for 12 months after traces of a banned steroid, nandrolone, were found in their samples, but a three-man panel subsequently upheld their appeals by a 2-1 majority.

The two players claimed the drug was present in supplements they had taken, but they had not taken it knowingly.

The International Cricket Council is, however, a signatory to Wada’s anti-doping code and the agency believes Pakistan, as one of the ICC’s full members, should therefore be subject to its provisions.

“Wada has exercised its independent right to appeal, provided in the World Anti-Doping Code, to the CAS against the PCB’s appeal panel decision to overturn the sports sanctions of two athletes who recently tested positive for performance enhancing drugs,” said Donze.

Since the lifting of the ban, Shoaib and Asif have been named in Pakistan’s preliminary squad for a tour to South Africa and they are both hoping to play in the World Cup in the West Indies which follows.

Dope issue: Tough time ahead for PCB

**KARACHI, Dec 22: **Pakistan Cricket Board may face a tough time in its efforts to defend the exoneration of fast bowlers Shoaib Akhtar and Mohammad Asif in a doping offence.

A PCB source confirmed that Pakistan was among the 186 countries who signed the Copenhagen Declaration on Anti-Doping in Sport and automatically fell under the World Anti Doping Agency Code.

Copenhagen Declaration was a political document through which governments signal their intention to formally recognise and implement the World Anti-Doping Code.

“Pakistan is a signatory and can’t say the World Anti-Doping agency regulations are not binding on it,” a WADA official said.

PCB Chief Nasim Ashraf had asked the international agencies like WADA and the International Cricket Council (ICC) to keep out of the “internal” matters of Pakistan Cricket, claiming the Board was not a direct signatory to WADA Code.

“I think we have a tough time ahead of us now. Because what the Chairman has said is certainly not factually correct. If Pakistan is a signatory to the Copenhagen Declaration than all its sports bodies including the PCB fall under the WADA ambit,” a PCB source said.

WADA on Thursday filed an appeal against the exoneration of Shoaib and Asif on doping charges by an appeals tribunal of the Board which also set aside their two and one year bans imposed in November by a drugs inquiry tribunal.

WADA has moved the Court of arbitration for Sports against the appeal tribunal’s decision, which has been defended by the PCB on the grounds that the bowlers’ issue was handled under the PCB’s own anti-doping regulations.

Re: BREAKING NEWS: Asif & Shoiab face anti-doping appeal

Its about Pakistan and about Cricket that they **play well in an annoying manner **against the comfort of its ‘Gora’ inventers and ‘Gulaam’ followers.

No surprises and no hard math.

Against these odds Pakistan has been doing very well in this sport

Re: BREAKING NEWS: Asif & Shoiab face anti-doping appeal

^ true...but I sure want to see how Naseema will get PCB out of this mess..

Re: BREAKING NEWS: Asif & Shoiab face anti-doping appeal

i wonder how long will it take for them to make a decision on that.if it happens before the world cup then i think these guys are in trouble because i am pretty sure they'll get banned again. There is also a chance that they might get tested during the south african tour or the world cup.I heard a doctor saying that this thing will stay in thier system for 8 to 9 months if they have injected it but if it was produced iin their system through supplements then its out of their system already.

Re: BREAKING NEWS: Asif & Shoiab face anti-doping appeal

^ In all its trueness this should be as normal as any other sports/drug controvercy else where in the world. Fact remains that it happens in a country like Pakistan where any thing brilliant or dungworth triggers an avalanche of comments and head shakes. Plus we the fans add fuel to the fire.

For instance EUC has warned Pakistan Govt if the coming General Elections found to be rigged then heavy sanctions will fall upon Pakistan. Now Isn’t this bit premeture and premeditated bullshyt, ?

In some cases PCB under any Chairmen has performed well in an organized manner that some modern counytries including ICC should consider taking a lesson or two.
When a rule affects the west they change it and call it - An Amendment.
When a rule is followed in the east to its best advantage and in all fairness is called a loophole that needs to be amended. What a dungload of crap

Pakistan will prevail Inshallah :jhanda: Sun loo yeh WADA !

Re: BREAKING NEWS: Asif & Shoiab face anti-doping appeal

^EU is just waking up or what?lol elections in pakistan have been rigged time and time again.its a norm.well i just think there was no need for icc to sign up with wada, they should have their own anti doping agency making judgements on these matters...like they have it in tennis and American sports.I mean wada is too strict on these matters.if the guys took it to recover from an injury and its no longer their in their system then how the hell are they enhancing their performance?wada sucks.

Re: BREAKING NEWS: Asif & Shoiab face anti-doping appeal

Well I think the statements of the first tribunal has alot to do with this. they should have kept their mouth shut. In order to justify themsleves they have done great damage to Pakistan cricket.

Re: BREAKING NEWS: Asif & Shoiab face anti-doping appeal

I agree with desidudecool. Nobody ever considers cricket to be a part of other sports and thats is why doping cases should be held differently too.

WADA is whipping cricket's doping offenders with the same stick it uses for other shorter sports such as soccer and more olympic type of sports. Cricket games are long and tedious, and often a career can last only 30-40 games.

If the same senetence is handed out to cricket players, that is handed out to other sportsmen, it greatly risks a total career flop for the cricketer - especially if its a bowler.

Pakistan pacemen still face ban

THE World Anti-Doping Agency may be able to reinforce the ban against doping-tainted Pakistan fast bowlers Shoaib Akhtar and Mohammad Asif, the country’s anti-doping tribunal chief acknowledged today.

“According to the WADA code they can apply for provisional suspension,” barrister Shahid Hamid said, quashing suggestions the players were now in the clear.

Hamid headed the three-member Pakistan Cricket Board tribunal which last month banned Akhtar for two years and Asif for one year, after the new-ball pair tested positive for the banned steroid nandrolone.

Both bans were overturned by a committee headed by a retired high court judge earlier this month, which ruled the pair had not been fully educated about doping matters.

As a result, the PCB insisted the doping case was closed and that any action by WADA or the International Cricket Council would not stop the pacemen from playing. Akhtar and Asif were included in their preliminary squad for next month’s tour of South Africa.

However, Hamid said Pakistan was obliged to follow WADA rules.
**“It is a fact that Pakistan government signed the Copenhagen declaration in 2003, like other 186 governments, including 38 countries in Asia,” he said. **

"Pakistan government has paid to WADA the annual and subscription fee for the years 2006 and 2007.

**“This declaration, through culture and sports ministries, binds us to follow the WADA codes and under clause 13 of their codes, the WADA has the right of appeal against the decision of a national anti-doping commission whether it is done during the competition or out of competition.” **

WADA last week challenged the lifting of the bans in the Court of Arbitration for Sports in Lausanne, Switzerland, saying any overturning was against its code, a stance backed by the ICC.

CAS was expected to hear the case in the new year.

Hamid also disagreed that Akhtar’s decision not to sign a contract with the PCB could give him any leeway.

“Akhtar has not signed the latest contract, but he has signed an identical contract before and that contract in its provision is identical and under clause 3 of the contract he was bound not only by the PCB but by the ICC anti-doping policies as well,” he added.

Hamid, however, refused to comment on the decision to exonerate the players.
“It is now for the CAS to decide,” he said.

WADA directs dope retest of Shoaib, Asif

ISLAMABAD: World Anti-Doping Agency (WADA) asked Pakistan Cricket Board (PCB) to stop Shoaib Akhtar and Mohammed Asif from playing international cricket forthwith.

WADA Spokesman in Pakistan Dr. Waqar Ahmed said Thursday that if PCB did not comply, ICC might stop both the pacers from playing cricket.

Talking to Geo News in an interview, he said that WADA’s case against Shoaib Akhtar and Mohammed Asif is strong and both the players should be given a dope retest and they ought to keep from international cricket until the performance-enhancing substance is fully washed off their bodies.

“ICC is authorized to stop the players from playing international cricket, in case PCB does not restrict the fast bowlers,” Dr Waqar added.

Didn’t ICC state earlier that they cannot ban the players since it was PCB internal matter and that WADA is the only external entity who has the authority to intervene:confused:
Looks like WADA is now doing nothing but Hawai firing :hehe:

Re: BREAKING NEWS: Asif & Shoiab face anti-doping appeal

icc should tell wada go to hell.and end its agreement with them.wada is not bigger than cricket.its a matter that should be decided by people who care about cricket.just like in greg rudzeski case where the matter was decided by people who are involved in tennis not by wada.

‘Autonomous body’ PCB to fight case of Shoaib and Asif: Nasim

  • Cricket board receives notice from WADA

Staff Report

LAHORE: The Pakistan Cricket Board (PCB) has received a notice from the World Anti Doping Agency (WADA) through Court of Arbitration for Sports (CAS) regarding its appeal against the exoneration of fast bowlers Shoaib Akhtar and Mohammad Asif from a doping case, PCB Chairman Dr Nasim Ashraf told reporters at Gaddafi Stadium here on Saturday. “We have also given a short reply to their notice,” he added.

Giving details, Nasim said the notice had asked the PCB to give a reply in seven days but the board had replied that it was not possible to meet the deadline because Eid holidays had started in the country. “The letter has also advised the PCB to deliver the copies to Shoaib and Asif. But we have refused to do so as it is the job and responsibility of WADA. They should directly post the copies of the notice to Shoaib and Asif,” he said.

Nasim said the PCB would fight the case despite the fact that the board was not under jurisdiction of WADA or Court of Arbitration. “PCB is not signatory either of WADA or of Copenhagen Agreement. Therefore, the case is beyond their jurisdiction. The government of Pakistan may have signed the Copenhagen Agreement, but the PCB is an autonomous body, having its own constitution, therefore, the case does not come under the jurisdiction of WADA,” he maintained. However, the Chairman said the PCB had great desire to be part of WADA in future and then it would follow their policy. “England-based lawyer Mark Guy will fight the case before the Arbitration Court.” To a question, he replied that Arbitration Court had not yet set any date for hearing.
