1) PCB should not have announced the names of the players initially and should have withdrawn the names of Asif and Shoaib on some other grounds and then an internal investigation should have been conducted.
2) The players should have been provided or atleast offered council during the the first hearing. PCB set up a tribunla to hear the case but the players were under contract by PCB and facing serious charges which would affect their careers and also the future of Pakistan cricket so the players should also have been offered legal representation from PCB to put their point across. This is a matter of medicine and law, they should have taken expert opinions from the legal minds and the expert doctors, I dont see the point of having an ex-player in the tribunal, he is not a lawyer nor a doctor and the charges have nothing to do with the sports it self.
3) Inctead of playing hide and seek PCB should come out in the open and announce if they are going to follow WADA procedures or not, if they are bound of WADA procedures or not. If we never signed anything with WADa why are we following their procedures and punishments ?
4) Players should always be better informed about the banned substances. If they are going to be tested they should know what the whole thing is about. I doubt someone like Asif knew a piss in the jar could end up as a 1 year ban. If he wasnt informed about the banned substances and never signed a central contract stating clearly to avoid the banned substances then he should definatley be cleared of all charges.
5) Shoaib should not be used as scapegoat for the whole mess cause of his life style. Whatever he did before off field is his personal business. He has paid the price for things he did as well like getting dropped from the team from going to WIndies cause of attitude problems. He should be judged soley on the merit of these allegations and if he was informed of all the banned substances, if he ever signed a new contract etc.
6) Members of the tribunal should be given gag orders during and after the hearing. It diesnt serve any purpose to come out and rub salt on the wound if you are going to ban him and brag about it or explain the decision. All you gotta say is the evidence given proved them guilty or not guilty and hence the decison. Anyone not following that should banned from holding any position in PCB.
pakistan is not obliged to ban these 2...i say the rest of the world can go to hell...lets give ourselves the best chnace of winning the world cup and bring back asif and shoiab...admit it ppl..shoaib was bowlin brilliantly since the november series vs england last yr (who cares about him boozing and laying women?? its his PERSONAL life) intikhab alam must just be jelous of shoaib gettin women :P ...i dont care about wat australians or englishmen or indians think about us...damn it...i want us to win the cup!!! KARACHI, Nov 28: A member of the original drugs inquiry tribunal expressed surprise at the demand of banned fast bowler Shoaib Akhtar’s lawyer for declaring the first hearing a null and void, saying the paceman was twice advised to make necessary changes if he desired.
Shoaib’s lawyer Abid Hasan Manto has objected to the damaging observations made on the bowler’s lifestyle by the original three-man drug tribunal in their final report after banning the bowler for two years.
The member said tribunal chairman, Barrister Shahid Hamid had twice advised Shoaib and his lawyer Noman Niaz during the hearing to go through the statement submitted by the pacer and make necessary changes if they desired.
“Hamid himself was surprised that in his statement to the tribunal, Shoaib had talked about his western lifestyle, sex life and other activities,” the member said.
“But Shoaib and Niaz came back twice with the same statement and the tribunal had no alternative but to accept it and when the findings were released Shoaib’s statement formed an integral part of the explanation of why the tribunal didn’t accept his argument and that he had taken the banned substance inadvertently.”
Any guesses who was this member of the original inquiry why hide Inti just come on out and give the statement. *
LAHORE, Nov 28: The three-member Appellate Tribunal of the Pakistan Cricket Board (PCB), reviewing the bans on Shoaib Akhtar and Mohammad Asif, is still struggling to reach a consensus-decision over the appeals filed by the fast bowlers against the punishment.
Informed sources told Dawn that the head of the tribunal, Justice Fakharuddin G. Ebrahim appeared clearly unhappy at the way the Doping Commission had conducted the cases early last month that resulted in respective bans of two and one year for the pacers. However, Fakharuddin had some reservations about over-turning or drastically cutting down the bans since the World Anti-doping Agency (WADA) could raise objections over the ruling.
PCB’s chairman, Dr Nasim Ashraf recently stated that Shoaib-Asif issue was an internal matter and WADA, International Olympic Committee (IOC) and International Cricket Council (ICC) had nothing to do with it. But despite that, what cannot be overlooked is the fact that the Government of Pakistan is a signatory of the IOC and WADA agreement and may become answerable if a favourable decision on the case is made by the tribunal.
It has been learnt that former Test cricketer Hasib Ahsan, a member of the appellate tribunal, has favoured the acquittal of the two bowlers on grounds that the WADA rules and regulations were not strictly adhered to by the PCB while taking the doping samples of the bowlers and in their subsequent transfer to the Malaysian laboratory.
jab khud ke dil mai chor ho to khul ke samnay nahi aa saktay.
What I make of all this [EMAIL="cr@p"]cr@p is that someone upstairs in PCB doesn't like Shoaib and they put these 2 guys on trial, if they had asked only Shoaib that would have brought out in clear but Asif got caught wrong place @ wrong time.
PCB's own lack of professionalism, lack of understanding got exposed and will further get exposed and come under question (nationally and internationally) if they come out in open and say whether they want to follow WADA or not. They are trying to fix everything under the table now, it has become a sore in their behind, jo bhee karayn dard hona hay :D
Lets give ourselves the best chance of winning the world cup and bring back asif and shoiab.
I want us to win the cup!!!
this is lookin good...hopefully the bans will be overturned...and possibly just made into 2000 dollar fines or sumin...
Are you telling me that you would slit the throat and sacrifice the pride of the nation for a lousy sum of two thousand dollars? Has that damn cup become too important that we have lost the sight of the real prize - nation's honor, integrity and dignity, which should, at any cost, come first and foremost? Why are we, in this day and age, so quick to offer the change and try to buy anything and everything that crosses our paths? Has the meaning of earning something gone into oblivion?
Those hypocrites at PCB and their double standards of judging everyone from a different yardstick instead of setting a baseline as their template. Nobody but the PCB itself is tarnishing it's own image.
pride of the nation??? so you would rather have a repeat fo the 03 world cup?? made us feel reall proud yea? or how about our abject failure at the champions trophy?? besides, if ppl like ruzedski can be acquited for nandrolone, and if stephen fleming only got a flimsy fine for doing marijuana some 8 years back (he is still captain even!)...!
Nothing new so far…^ is still the latest…so I really hope we will get Asif back…What a great thing that will be inshAllah…Asif/Gul under guidance of WICKI…
In swinging yorkers all the way…
Pakistan fast bowlers Shoaib Akhtar and Mohammad Asif will find out on Tuesday whether their appeals against doping bans have been successful.
A tribunal banned Shoaib for two years and Asif for one year for testing positive for nandrolone but an appeal committee has been gathering evidence.
Committee head Fakhrudin Ibrahim will announce the decision in Karachi at noon local time, 0700 UK time.
Both men have insisted they did not knowingly take the banned drug.
The appeals were heard by a three-man panel, including retired judge Ibrahim, former Test player Hasib Ahsan and Dr Danish Zaheer. They were being assisted by London-based lawyer Mark Gay, who represented national team captain Inzamam-ul-Haq at a disciplinary hearing in September following the controversial finish to the Oval Test against England.
