Accused acquitted in Sonia Naz case

LAHORE: An additional district and sessions judge on Thursday acquitted suspended SP Khalid Abdullah and Inspector Jamshed Chishti of charges of kidnapping and raping Sonia Naz.

The judge acquitted the accused while accepting their applications. Earlier, the court had repeatedly summoned the victim but she failed to appear before the court. The counsel for the victim had also moved an application, requesting the court to put off the trial of the accused until she appeared before the court.

However, the court rejected the application and accepted the acquittal applications of the accused. Earlier on December 23, 2006, the trial court had started the process of proclamation of the victim as she was not appearing before the court. Later, the court also directed to attach her property and issued her arrest warrants, but she did not join the proceedings.

According to the prosecution, SP Khalid Abdullah and Inspector Jamshed Chishti abducted her on May 3, 2005, from her home in Johar Town and raped her. The accused were arrested on October 19, after Pakistan Chief Justice Iftikhar Muhammad Chaudhry, while taking suo motu notice of the case, had directed the police to arrest the accused.

On the order of the Supreme Court, the Sattu Katla police registered a Hudood case against them on October 12, 2005. Earlier, Naz filed her complaint at the Sattu Katla police on September 2, 2005, but the case was not registered. The accused were booked under Sections 10, 11, 16, 18, 7/ 79 of the Hudood Ordinance, Sections 344, 354, 355 and 506 of the PPC and Section 155 of the Police Act in the FIR 650/05. The case received publicity at national and international level and the federal government also took a serious notice of the unwarranted attitude and conduct of both accused police officers.

Maybe she is in fear of her own or family safety and this just backing out, who knows, the system is so screwed up.

The second link says that accused had threatened to kill her children if she dared appear in court.

Judges in Pakistan some time acts smart, dont they know the power of Hawaldar in Pakistan police, and they are calling the victum to testify against SP and Inspector.
On the other hand, incident held on May 2005 and today as we speak is April 2007, she is still in middle of no where, whereas accused may have ruined many other lives.

This is disgusting. I wish Musharraf would grow some balls and throw all these people into jail and hang them.

does pakistan have something similar to a witness protections plan? if not it needs to have it, because ppl are afraid to report against police, because then they get all kinds of trouble.

They can't be thrown into jail without due process and trial, which requires the person laying charges to be present at court.

Unless you'd prefer we'd skip the whole trial part and presume guilt.

Why are they not showing up to the trial? Is it a belief beyond believing that perhaps someone has threatened them?

Secondly, arent you gung ho about Shariah? Don’t you know that when a believing woman told the Prophet she had been raped by person X, that the person X was hung?

There was evidence presented in the trial - all that gets thrown out of the window because the victim didn’t show up? And her lawyers were requesting for the trial to be postponed so that she could show up?

Id like to second Fraudzs question...are there witness protection programs in Pakistan...
This is a rape case but can they do this is say criminal investigations where they have an inside man that testiifies...lol too many gangster movies for me but just curious...

Witness Protection Plan, you mean Govt should forget security of all VIPs and start putting up budgets to protect common people. comeon, it is Pakistan we are talking about, where justice is still a dream yet u are talking about next stage...
