ISLAMABAD: Chief Justice of Pakistan (CJP) Iftikhar Muhammad Chaudhry on Thursday decided that he would not be a part of a nine-member bench formed to hear Jamaat-e-Islami chief Qazi Hussain Ahmed’s petition challenging the two offices law (President to Hold Another Office Act, 2004) from September 17.

The second senior most SC judge, Justice Rana Bhagwandas, will head the nine-member bench. The other members of the bench are justices Javed Iqbal, Abdul Hameed Dogar, Sardar Raza Khan, Khalilur Rehman Ramday, Muhammad Nawaz Abbasi, Faqir Muhammad Khokar, Falak Sher, Mian Shakirullah Jan and Javed Buttar.

Earlier a seven-member SC bench headed by the CJP on September 6 sought help from three prominent constitutional experts – Aitzaz Ahsan, SM Zafar and Abdul Hafeez Pirzada – as amicus curiae (friends of the court) and fixed the case for regular hearing from September 17.

The CJP has also constituted three benches to hear other cases during the hearing of Qazi Hussain’s constitutional petition. Bench No 1 would be headed by the CJP and include justices Nasirul Mulk and Syed Jamshed Ali. Bench No 2 will include justices Rana Bhagwandas, Nawaz Abbasi and Faqir Muhammad Khokar. Bench No 3 would include justices Javed Iqbal, Abdul Hameed Dogar and Shakirullah Jan while Bench No 4 would include justices Sardar Raza Khan, Falak Sher and Javed Buttar. Bench No 5 would include justices Khalilur Rehman Ramday, Chaudhry Ijaz Ahmed and Ghulam Rabbani while Bench No 6 would include justices Tassaduq Hussain Jillani and Raja Fayyaz Ahmed.After an adjournment or in case of a decision on the petition filed by Qazi Hussain, the nine-member bench will be reconstituted.

One of the few good things Jamat has done for Pakistan, this is way to go to fight the army rule instead of "bargaining", "agreement" etc I hope they have good lawyers.

I agree. Using Islam's name for political reasons is just worst.

But out of all these MMA parties, Jamat is a little better as they have done some good things too. And this is surely a good step.

The desire of Musharraf to continue to hold the role of COAS suggests that he lacks confidence in his own institution. How can anyone hold two full time jobs at the same time, particularly such high profile roles as COAS and President? In one he is purely a civil servant accountable to the government and then in the other he is figurehead of the State.

When the CJ was restored nearly two months ago, it was said then that it was part of a deal with Musharraf that Iftikhar would not sit on any bench that heard a case regarding the Unformed Presidency. Of course die-hard CJ supporters (blind that they are) said angrily that their man would never agree/do such a thing! Well he has done just that.:slight_smile:

Does the situation sound familiar now? Hint: Lal masjid operation.

Govt knew whats boiling up there but they never took action, but they waited for a "phone call" to take the action, this time the call probably came from China instead of usual source. We all "appreciated" government cleaning up the mess and ignored the "timing" and politicising of the event, similarly even if Jamat is doing it because their negotiations were unsuccessful at least they are not going out on streets and bombing/killing people.

The mullah who gave fatwa against "woman ruler" and then joined her very own government was Molana Diesel I believe.

not even a single man can dare to point a finger on him..in these 40 years...

and now this great man ..is going to play his last and biggest innings....

he is finally going to retire in November 2007....at age of 65....

and from Monday...he is going to listen ....the most important case of General Musharraf Election from same assemblies and Uniform issues....

6 petitions are combined into one large petition....

previously there were 10 honurable judges in this larger bench headed by CJ Ifthikhar Muhammad Chaudry...

but yesterday..CJ sided himself from this bench..and gave the leadership to Justice Rana Bhagwandas ..his seond most seniour judge of the SC of Pakistan...

and now Justice Bhagwandas will going to decide the fate of the most "powerful " man of pakistan today....

but Dictator is not so powerful...the real power is to SC ...and to its head Justice Bhagwandas .....whose pen ..can kick the Musharraf out of his seat....

in last 2 months of his retirement...with ultra brilliant career of 40 years....

Now see ..how Justice Rana Bhagwandas ..chairing the bench of 9 honourable judges will decide about Musharraf...

Well whatever happens happens, but I'm thinking the dates and deadlines are too tricky, VCOAS retires on 8 Oct, President says he'll be re-elected on or before that date, Bhagwandas retires in Nov, (what if the case doesnt conclude till then?), BB coming on 18 Oct, election date still not announced...
