The 20th amendment is related to the elections conducted when there was no Election Commission, 28 members have today got disqualified because the government has not been able to get the elections of these people regularized through the assembly. PMLN wants to sign the 20th amendment, but they want to have the issues of appointment of CEC and formation of caretaker government included in it.

ISLAMABAD: A four-member bench of the Supreme Court (SC) suspended the membership of 28 member assemblies until the passage of 20th Amendment, Geo News reported.

The SC resumed the hearing of fake voter lists case today.

The bench comprising Chief Justice Iftikhar Muhammad Chaudhry, Justice Khilji Arif Hussain, Justice Tariq Pearvez and Justice Sarmad Jalal Usmani is hearing the petitions filed by Pakistan Tehrik-e-Insaf (PTI) Chairman Imran Khan, former Prime Minister Benazir Bhutto and others.

Earlier on January 19 during the hearing of the case, the CJ remarked that the court will have to annul the by-elections, in case the Constitution is not amended.

The court gave the government time till February 6 to adopt 20th Amendment of the Constitution. The Chief Justice Iftikhar Chaudhry said that if the Constitution is not amended by February 6, then the court will have to annul by-elections as unconstitutional, as there are over 3,500,000 bogus votes in the old lists.

**The fate of 28 parliamentarians hangs in balance as they would be rendered disqualified if government failed to have the 20th Constitutional amendment pass in both Upper and Lower Houses.

Also included in this lot are Finance Minister Senator Abdul Hafeez Sheikh and Petroleum Minister Senator Dr Asim Hussain**

Even president can do it!!! infact in today's date only president can do this, gillani won't dare to do this or any other such thing until Zardari orders him to do so..

What has this issue to do with rest of the seats in all assemblies? Why dissolve?

He gave that away and then took it back as a result of famous 18th amendment, where the decision of the party head has to be accepted by all elected members of the parliaments...failing to do so would or can have them suspended... so the President of Pakistan who happened to be the Chairman of the party have the upper hand any way..

Situation is worse in PML-N's case, where the party head is not even the elected member of the parliament!!!

And it passed. I find the EC 5 tenure bit interesting. Why 5 years?

From this ammendment, this is what i understand

a procedure for transfer of power, i.e. how to bring interim govt acceptable to all parties in parliament to ensure stability in transfer of power

now thing i do not understand, what steps have been taken to make EC independent and strong?

President’s role in caretaker set-up eliminated

ISLAMABAD: Even a minor role for President Asif Ali Zardari in appointing the caretaker prime minister to hold general elections has been eliminated by the 20th Constitutional Amendment, the draft of which has been approved by the federal cabinet. The president has been left with only the function of administering oath of office to the caretaker premier and his cabinet members.

Thus, a major demand of the Pakistan Muslim League-Nawaz (PML-N) that the president would not have a major president would not have a major say in putting up the federal and provincial caretaker set-ups has been accepted. Now, a workable institutionalised mechanism has been put in place instead of letting the power vest in one individual.
As earlier introduced by the 18th Amendment, the president had a dominant role in appointing the interim prime minister through “consultation” with the outgoing premier as well as the leader of opposition.
The PML-N has remained skeptic about the process of “consultation” by the present government, which it claims has never been meaningful, purpose-oriented and consequential as experienced by it in the appointment of two chairmen of the National Accountability Bureau (NAB) and the Abbottabad Commission. Its lack of trust drove it to excise any role of the president in the nomination of the caretaker prime minister.
Under the 18th Amendment, this presidential power was almost discretionary as is evident from clause 1 (1A) of Article 224, which says that on the dissolution of the National Assembly on the completion of its term or by the prime minister earlier, the president shall appoint a caretaker cabinet. Its proviso read that the caretaker prime minister shall be selected by the president in consultation with the prime minister and the leader of opposition in the outgoing National Assembly.
In this process, Zardari has exclusive power to choose the interim prime minister through consultation with the outgoing prime minister and opposition leader (Chaudhry Nisar Ali Khan in this case). The two sides have never agreed on any issue through “consultation” because of their own preferences.
In the provinces, the president’s representatives, the governors, were to follow the same formula by holding consultation with the respective chief ministers and opposition leaders. However the 20th amendment has brought basic changes in this method. Now, the Election Commission of Pakistan (ECP), meaning its four members, who are retired high court judges, and the Chief Election Commissioner, will have the final say in appointing the caretaker prime minister as well as chief ministers.
But the ECP will spring into action only if no consensus is reached in the two earlier processes. First, the prime minister and opposition leader will attempt to arrive at an agreement on the nomination of caretaker prime minister. If they fail, they will send their respective names to the speaker of the outgoing National Assembly, who will refer them to an eight-person committee having four members each from the government and the opposition to be drawn from both Houses of Parliament.
In case this committee is also unsuccessful in arriving at a consensus, it will transmit the names to the ECP, whose decision will be final. The entire process will have to be completed in a week’s time. In the provinces, the same new formula would apply.
The previous provision inserted by the 18th Amendment has been kept intact that members of the caretaker cabinets including the prime minister and chief minister and their immediate family members (spouses and children) shall not be eligible to contest the following elections.
Additionally, members of these cabinets shall be appointed on the advice of the caretaker prime minister or chief minister, as the case may be.
