The Asghar Khan petition was going through the maintainability process wherein court decides if a petition which has been directly filed in the top-most court, merits to be heard in the top court, be dismissed, needs more substance or should come through lower courts. No direct order can be passed on a petition during its maintainability process.
Once a petition is heard and termed as maintainable by the top court, it is sent to the government for action which means that the government should approach the court through its attorney general for penalizing the culprits.
