ISLAMABAD: Former Lahore High Court (LHC) Chief Justice Khawaja Sharif will defend Mumtaz Qadri, the murderer of Punjab governor Salmaan Taseer, in court on Tuesday, confirmed Lawyer Raja Shujaur Rehman.

Justice Khawaja was appointed Chief Justice of the LHC on April 12, 2009 and retired on 8 December 2010 on attaining the age of superannuation. He was appointed to the court on May 21, 1998.

The CJ remained deposed from the bench from November 3, 2007 till March 17, 2009 when he was restored.

The Divisional bench (DB) of the Islamabad High Court (IHC), comprising of Chief Justice Iqbal Hameedur Rehman and Justice Riaz Ahmed Khan will hear the case at 10:30am in the IHC.

Qadri had filed an appeal before the IHC earlier challenging his death sentence. An anti-terrorism court (ATC) sentenced Qadri to death earlier this month on two counts for the murder of Taseer. The self-confessed killer’s defence pleas, which invoked religious sentiments and argued the accused was provoked into the act, were dismissed by the court.

Qadri, a constable in the Punjab Police and a member of its Elite Force, tried to justify his murder of the governor by stating that he had killed him for supporting Aasia Bibi, a Christian woman whom Taseer had believed had been wrongly convicted of committing blasphemy.

Terror in the courts

Qadri’s trial has remained a controversial one, with violent protests being taken out across Pakistan against the verdict.

Additionally, the Anti-Terrorism Court Judge Pervaiz Ali Shah who passed the death sentence for Qadri was transferred to Lahore on Friday amid protest from religious groups.

The ATC judge who had sentenced Malik Mumtaz Qadri, the assassin of Punjab Governor Salmaan Taseer, was transferred to Child Protection Court Bureau in Lahore, merely a month after he was posted to Rawalpindi.

The judge had been unable to perform his duty due to the hostility of a certain group of lawyers and other religious groups who had been asking the authorities to hand Shah over to them.

The lawyers had earlier asked the government to transfer the judge to some other city. The Rawalpindi District Bar had passed a resolution giving a five-day deadline to the government. The decision came after the nationwide strike by religious parties on Friday.

I dont know about the rest, but he certainly is one of the ugliest criminals in Pak history.

you know what, go and read it yourself. I know law of the land should be implemented or else we have anarchy. He has done a murder, admitted doing it. he can only be given some relief cause he admitted to the crime.

and for mr taseer, I do not know if he did or didnt directly disrespect the Prophet(PBUH), i know he wasnt proven guilty of the crime or a fugitive.

I do not agree with what he has done, but he should not be hanged. Do not allow him to become another martyr a life in prison would be more appropriate.

^ if the law says murder punishment is to be hanged then why not? the only relief he can get is to get life imprisonment instead!

The law is clear the courts has their discretion to impose various sentences, including Death or life improvident both are possible for murder case.

Another thing since blasphemy is something very serious matter for every Muslim (although i doubt Salman Taseer committed blasphemy).

One must remember for Muslim respect of Rasool Allah SAW is more important then anything in the world, thus anyone commit a blasphemy should understand that he is causing extreme provocation to any Muslim by doing so.

I do not agree with current law, but there is possible someone kill the person who commit the blasphemy on ground of extreme provocation. Thus entilted for lower end of sentence.

He won't be martyr, but he is a murderer for sure. Lets hang him so noone else would do that again.

I do agree there no shortage of crazy people who made martyr of his death, let not give them this pleasure, let him suffer in the prison for life.

most appropriate is life imprisionment ,he should be made an example of a criminal not a martyr.

ISLAMABAD: A court on Tuesday suspended a policeman’s death sentence pending his appeal against conviction for killing a provincial governor.

The Islamabad High Court held a preliminary hearing to admit the appeal filed last week by lawyers for Malik Mumtaz Hussain Qadri, who was working as one of Punjab governor Salman Taseer’s bodyguards when he shot him dead.

“The high court suspended the implementation of the death sentence awarded by the anti-terrorism court until the appeal hearing concludes,” said defence lawyer Shuja-ur-Rehman.

The court’s two-judge panel will now fix a date for the next hearing, he added.

Qadri has confessed to killing Taseer in a hail of bullets outside an upmarket coffee shop in Islamabad on January 4.

Qadri was convicted of murder and sentenced to death by an anti-terror court on October 1 but the verdict led to an outcry by his supporters.

Rehman said the court had rejected a verbal request by the defence lawyers for the appeal to be heard in open session for security reasons.

The anti-terror trial of Qadri was also held behind closed doors, at the high-security Adiyala prison outside Islamabad.

Meanwhile, hundreds of demonstrators have rallied in support of Qadri.

Tuesday’s rally took place as Qadri appealed his death sentence before a high court.
