So on what basis do you think any penalty should be administered? Your question is very vague in its details for an answer as specific as what a punishment is/should be. In general, in order to make a ruling against anyone, the facts and evidence would have to be considered. Whatever those would/could be would be very dependent on the specifics of the situation.
