The hadeeth i have given is regarding hudood only being allowed to be implemented by the Sultan meaning a punishment can not be dealt out without the presence of a ruling body ruling hollistically by Islam.

In Sunni Islam, the khalifa follows the edicts of the ulemas that make up the council to advise him.
These same ulemas can even have the khalifa removed - under the sunni khilaphate!
