By different treatment i do not mean that you do not punish one and punish other. I mean that rape is fitnah and you do not treat it as adultery and put it in hadd where it is mandatory to have 4 witness. you can have DNA test to check if rape was committed.
Putting them in same group puts the onus on women to prove their innocence by proving beyond doubt that it was bil jabbar otherwise it is automatically bil raza and the women goes behind the bar and the man absconder.
Let the man prove that it is bil raza otherwise it should be treated bil Jabbar, even if you prove through Sunnah that they both are in hudood(Quran does not mention anything). No women can have sexual intercourse with a man without his will. And as the men have been given “fauqiyat” or authority so with authority comes responsibility.
