**mtha was allowed in war ,Jahad only in the circumstances of early days of Islam.Those days army was supposed to stay for long at new places and reaching back to home took at least weeks in travel. So keeping away from sin a permission was given subject to the will of the local woman. It is like slavery of that time as a routine matter of that time and now both are not allowed.

I have seen a post about passing an order by caliph.
A caliph is Imam ul waqt and Mujtahid ul asr also so he can pass orders.
