Because either they are not earning enough to sponsor their spouse or their spouse has not passed the english test to become eligible to make a application.As someone else has said in his post the immigration laws are becoming strict because some people abuse them and try to get in through fake documents.

**LONDON: The Court of Appeal here has upheld the lawfulness of the minimum income threshold at £18,600 under the new family migration rules, which means that thousands of Pakistani applicants seeking to enter Britain through family route will face difficulties and long delays in family reunions.

Pakistan and India are amongst the top five countries from where the highest number of spouse visas is applied each year to settle into Britain.The minimum income threshold for British citizens to sponsor a non-European Union Area spouse or partner or child to come and live in the UK was introduced in July 2012. It aims to ensure that family migrants do not become reliant on the taxpayer for financial support and are able to integrate effectively. The minimum income threshold was set at £18,600 for sponsoring a spouse or partner, rising to £22,400 for also sponsoring a child and an additional £2,400 for each further child.

Immigration law expert, Farhan Farani of the Farani Javid Taylor Solicitors, commented that the Court of Appeal’s decision to allow the Home Office’s appeal against the challenge to the £18,600 threshold will leave thousands families “in limbo and many more unable to apply to bring their families to the United Kingdom.”

Farah Farani said that the Home Office had stated that the policy behind the requirement was for the betterment of the United Kingdom’s economy and this argument was accepted by the Court of Appeal.

“It was also largely accepted that immigrants on a higher income would be able to integrate into the United Kingdom’s society with more ease. The decision will most likely be challenged in the Supreme Court; however, this is little help to the thousands of families who are separated and will have to wait for many more months until the final outcome in the Supreme Court.”

He said the judgment will have huge impact on those applications which were put on hold. The judgment will mean that from the 28 July, the 4,000 individuals whose applications are currently on hold, pending this judgment, will now receive a decision. These are cases which met all the requirements apart from the minimum income threshold and now stand to be refused.

“The implication of the judgment will be that all British spouse visaapplications which are on hold for failure to meet income threshold will be refused. Those British families who do not meet the requirements will be banned from making applications in future as well. These decisions will attract right of appeal and the main course will be to win these appeals under Article 8 of ECHR (right of family life),” he added.

Immigration and Security Minister James Brokenshire said that the Court of Appeal has comprehensively upheld the lawfulness of this important policy.“We welcome those who wish to make a life in the UK with their family, work hard and make a contribution, but family life must not be established in the UK at the taxpayer’s expense and family migrants must be able to integrate.

The minimum income threshold to sponsor family migrants is delivering these objectives and this judgment recognises the important publicinterest it serves.”The aim of the new rules to help reduce immigration and the Home Office has said that family visas issued have fallen by more than a quarter in the last four years but this is causing immense strain on the families affected, said Farhan Farani.

I don't understand why nadz keeps asking the same questions over and over again. I don't even live in the UK and I seem to know the laws and regulations better then she does just by reading these repetitive threads :D

The UK Supreme Court is hearing a test case on the validity of the income criteria later this month - after that we will have a sort of final verdict but may end up in the EU courts after that...

For your purposes the current rules are that you need to meet the income criteria.

If you have a specific question then plz do ask - it seems that you don't really..

I don't either.. A little ridiculous if people are complaining about needing to earn 18k.. it's quite a bit below average income in the UK..

They should get off their backsides and work instead of moaning about 'how dificult' it is because really it isn't hard for anyone who chooses not to sponge off others..

I am sorry but I do not agree with this at all. £18k in the UK is above average. Not everybody can get those wages and many like myself are having to work 2 jobs in order to bring our spouses over. I have also heard of the fake payslip dilemma but I wouldn't do that. I want to bring my spouse over legitimately and I am prepared to work for it and meet the requirements before I actually apply.

I think the issue that people have with delayed visas is actually the fact that they don't meet the requirements or they make mistakes in the documents or they don't submit all the documents which delays the process. It is better to get all the documents in order and apply once you actually meet the requirement.

Whose they deeba . Are you insinuating it's me. But fed up of people opening forums for people to ask questions but then ridicule them for doing so.

I am working. And not moaning. And yes 18k is a lot. You may be earning it, well done to you. But find out the facts first. average wage isn't 18k.

Thanks Mahool many of these jobs I'm applying for don't offer these salaries. I know as I've applied. I have one now but not 18k yet.

£18,000 is about $28,000 right? That's about what the average 9-5, clerical/entry level salary is, or what you can make working as an assistant manager at a retail store. Not really that hard to do here. I'm surprised that the average, educated person in the UK isn't earning that much? Isn't the cost of living much higher there then it is here, say in Texas? Because I'll tell you a married couple, much less a family of 4 would barely be squeezing by on $28,000 salary as the sole income.

And teacher ( I'm.Not a teacher have no teaching qualifications) do not get 32!

My sister is, and she gets nowhere near that .

I'm not insinuating anything about you, Nadz.. I meant people complaining about needing to earn LESS than average to bring their spouse into the country and wanting to lie or find loopholes to try and get round it.. You need to get YOUR facts straight if you believe 18k is a huge deal because the figure £26,500 is there in black and white..

Khatti, it isn't difficult to earn that here either.. If you look at the list a lot (if not most) of the figures below that average are part-time and/or don't require higher education.. A graduate really shouldn't be struggling that much to make 18k.. Here in London the average is over 30k a year..

Let's not forget that @nadz123 just spend some (several?) years in Pakistan and her work resume probably hasn't been updated since she left UK, so she might not have found the most suitable job right away, hence not earning whatever is the average salary in UK.

The problem with the income cap is for British people who come back after living somewhere else. They have to struggle in the first year or so.

While all the numbers look fancy getting a job is harder than it looks. Teaching jobs in UK are very hard to come by, graduate jobs are almost impossible to get. However you can still get to the 18k amount but you will have to work hard and do overtime for even the 'low' jobs, stuff like clerk jobs in hospitals or offices etc so its upto you to buck up. If you have experience in a specific field and an education then that's a bonus. You said you're working, on a minimum wage atleast, so you must be earning nearly 13k at the very least so you can't be that far off. See if you can get another part-time job, surely you can as you only need 5k or so more.
