Sorry for the long post...I tried to be as brief as possible and highlighted the copy/paste article with bold fonts so that you can read only the relevant portion...however as it is necessary to understand the legal issue involved it was necessary to give a little detailed explaination...

As for your question....how can the judges who have taken a sommersault from their original position....and negotiated their reappointment with the executive authority be independent and principled....they owe their reappointment to these compromised negotiations....they will always be obliged to executive who selected them for reappointment...

This is exactly what I have tried to highlight from the article...The judges are not being restored....they are selectively being reappointed as a result of a compromised negotiation with the executive....

They can be reappointed if we agree that they were sacked in the first place means 3rd November action was legal....but there is no way there seniority can be restored according to article 256 of the constitution....they are actually being cheated by Farooq Naek who has assured them their seniority will be restored....once challenged in Dogar court it will be easily brushed aside and their seniority will be taken from the date of reappointment....

Faisal the whole point is that you and I can not do anything in this matter....however we can support principles and say black is black and white is white...atleast....!!!!

As far as Dogar/PCO judges/reappointed judges are concerned....there will be a very strong case against them for misconduct....as they are abrogating Pakistan constitution and are showing their loyalty to the executive instead of constitution....on which they originally took oath....and will also face charges according to article 6 for conspiring against the constitution....once independent judiciary is reinstated....

I agree with Yazdi, even though the PCO of 2000 was validated by the parliament thanks to the MMA, we dont really care about that because our support for the ousted CJ is based on his heroics in 2007 (and 2008), where he proved that he was the first ever head of the judicary, worthy of leading it, independent from the parliament and the presidency.

Sorry yaar, but Pakistan never had independent judiciary & it never will. Its not in interested of ruling class to have pesky judges looking over their shoulders. As for their reappointment, that shows how far their (judges) principles go, and let me also tell you that they would've never stood up to the dictator had it not been for the public & lawyers' community.

None of these judges who took oaths on PCO1 & PCO 2 are saints. They're all-all the same & its goes for Iftikhar Chaudhary, too. What is wrong is wrong no matter how u look at it.

BTW, I think if he is really standing up for principles than he owes nation explication for his first PCO oath. Also, if he really believes in his mission he should resigned & leaver as statesman, and not become an obstacle in new democratic system & let it run its course.

Well if he resigns it's a different story...what if he doesn't resign....isn't the present government also restraining him from doing his job illegally....

Don't you think the present democratic system can run best if they remain within their legal parameters and do not exceed their mandate...if they want to legalise 3rd November actions don't you think parliament is the right forum to do so....and validate the illegal actions taken then....what is the difference between Musharraf and present democratic government if both of them resort to illegal means???

I am sure being a lawyer you know these things much better....Pakistan never having an independent judiciary in the past doesn't mean we should never have it in the future also...or atleast if we can not have it in short term future we can continue to support this cause....until we can achieve it!!!

Well, let me be devils advocate here & say that Nov 3 actions were not doing of this govt & nor is its responsibility correct it. However, I do agree with you that no constitutional cover should be given to anyone who has done anything illegal. Thats why I think Mushrraf should be put on trial for treason along with judges and lotays who helped him in criminally rapping constitution.

I have come to the conclusion that ousted judges are not about moral principles, nor do they're care about constitution or legal matters. They're there for themselves & nothing more.

Therefore, in my opinion, system and institutions should not be used to reward some people or punish others. Institutions should be use for general welfare of the public. That is why I think all the judges should be thrown out & replaced with people who have clean past which is what PPP govt wanted to do, but NS refused....that would've been better option...

Shamraz...don't you think this would be an illegal thing to do by the present government....can you suggest a legal procedure to throw out all the judges and replace them with a new ones...if the present government sacks all the judges what will be the difference between them and Musharraf...

Don't you think democracy will be best served if everyone remains within their legal boundaries....and without exercising executive powers to do illegal things,,,

Present govrnment is already reappointing the deposed judges....means they are accepting that the deposed judges are sacked due to November 3rd actions and need to be reappointed....without gettting November 3rd actions validated by the parliament through a constitutional ammendment...don't you think this already is an abuse of executive authority....

Of course its abuse of executive authority, but you have keep in mind that these r very same judges who gave Mushrraf the authority to amend the constitution at will, when they themselves had no power to change a single world in the constitution. So, tell me what credibility do these men have?

Alhamdulilallah. God Bless Great Zardari. 21 of the 36 former PCO judges have taken new oaths and accepted that the actions of 3 Nov were constitutional.
