When state is unable to defend its citizens from exploitation of loopholes in the judicial system, then all laws which provide such excuses should cease to exist immediately.

Got’cha ! I say almost all Muslim Governments have been unsuccessful in running their countries Islamically. Let’s just purge Islam altogether then, why don’t we !
