Your best bet would be to call USCIS at their toll free # and they can answer any questions that you have about this.
Some countries like the UK do not recognised Common Law Marriages. Therefore, the only way to get the legal benefits (such as tax advantages) of marriage is to register a marriage under civil law.
If you do that and you want a rock solid guarantee that in event of divorce things will be settle Islamically...you can only be sure by having a separate pre-nup.
In a british court, a nikkah nama made in Britain is as utterly worthless as the paper it is written on.
Incidentally, a nikkah nama from a country where nikkah is the legal way of getting married counts as a legal marriage for British legal purposes, but not as a pre-nup under british law.
So if you just get a nikkah in Pakistan and then your wife comes to the UK and then divorces you.... the divorce and asset split would be handled under British law.
It should to be a legal pre-naptial agreement that needs to be signed. Nikahnama anyways does not have any clause as such

but both types are part of woman's right and should be part of Nikahnama
off course we all hope that no one has to give the second type to any muslim woman, may they all be safe, secure and happy in their home

Dont have to. I know they recognize it as a valid legal document. Me and 20 others I know in islamabad embassy were not asked for anything else beside nikah nama. I brought my wife to the US after we got married. I was just curious on how is it that govt agencies differ from each other.
This is the second question regarding this topic. The first one is in Life1. Is this some new kind of thinking going on amongst Muslims in the US? How can registering your marriage with the state bother someone so much?
