Not only married but consumed also. Unless her new husband divorce her, she can not marry her old husband. These 'maut ke saudgar' use this as legal prostitution, or Dulhan ek raat ki.

Khula must be allowed and is a different thing. Halala happens because a divorced couple cannot get back together, even if they want to, unless the woman is married again to someone else, consumed that marriage, and then got a divorced. Halala is a questionable practice, because a nikah with an intention of divorce is not a valid nikah to begin with. So if person A is asking person B to marry his ex wife and then divorce her so person A can marry her again (now she is halal for him, hence the term halala), then according to almost all school of thoughts, it's not allowed, as nikah (of person B to ex Mrs A ) with intention of divorcing her after two days, is not allowed.

Btw, what was this ashrafi guy mad about as Marvi really didn't insult anyone (they were facts) and she wasn't even talking about Ashrafi there. Some of his stands might be useful but I would keep ashrafi two arm lengths away or more.

i'm afraid this is the way the crooks do it. it's a kinda 'loophole' they have found in Deen as well. peopletry to cheat Allah [nauuzobillah] the same way the cheat each other.

Halaalah is NOT arranged or is NOT 'temporary'...if that was the case then divorcing your wife would have been a trivial thing. in a poor country and where 'might is right', the influential husband can easily coerce someone into marrying his divorcee with JUST arranged nikaah and and arranged talaaq without the marriage being consummated even. this is not what Allah has intended.

the correct and desired way of Halaalah in the sight of Allah is when a divorced person marries someone out of his/her own free will with the intention to stay married for life without any social/moral pressure put on them [without any pre-arranged understanding to get a divorce]. now, if the divorce happens between them [without planning] naturally, then she will be Halaal for her EX to marry her.

anyother way is a big sin and is tantamount to prostitution/gross violation of hudood set forth by Allah.

Marvi makes all valid points here and she is right when she says that not every Tom Dick & Harry should be called a maulana or aalim (our nation's biggest tragedy!). But she could have toned down some of the language... jab tak fauj inn k moun mein thoonstey rahen khuraak etc. Ashrafi is known to have links with the army and the ISI and was even called upon by the army to speak with the terrorists after the attack on GHQ. Ohh then yeah I didn't know that background. But still, he shouldn't have gone all hyper over that. It might be distasteful but it isn't personal like sita white or altaf hussain's wife etc.
