Kalabagh dam cannot be built through court orders. The way it has been politicised, I would prefer to let the consequences of not having it argue for the its creation.

This is the legal position on the issue, and court has decided strictly according to the legal position. Courts do not decide according to political, personal wishes of the people. they have to go strictly according to the law. Unless CCI's decision is modified by the parliament.. it is binding on the federal government. Resolutions of provincial assemblies have no legal value as per the law. CCI decision has not been modified by the parliament as to this date.. so the legal requirement is:
1) Comply with CCI (which is the right forum for such decisions) decision.
2) Or Modify the CCI decision through parliament.
People who are criticizing the courts should at least read the decision. It's so stupid to equate LHC decision which is strictly taken on legal grounds with Rome-Ranjeet Singh. It's ironic that people support legality only when it suits their personal likings.
Nisar Khuro, Sharjeel Memon or Sindh Provincial Assembly are nobody to decide about the construction of KBD. The right forum is Council of Common Interest.. who have ratified the dam twice. Now unless this decision is modified by the Parliament it is binding on the government.
Regarding the consensus.. it is up to the stake holders to form the consensus. How they do is not for the court to decide. Pakistan needs new water reservoirs for water needs as well as for the generation of viable energy. I am of the opinion that to form a consensus they should revisit the water distribution formula giving more share to Sind, South Punjab, Baluchistan, and KPK where water can be used to cultivate new lands. Rest of Punjab can easily meet the water requirements by stopping the water wastage's and using water more effectively through drip irrigation instead of flood irrigation.
This decision should be beyond the decision making of provincial assemblies. What ever is good as a whole for Pakistan must be implemented.. and CCI is the right forum to discuss these matters. Unless we can decide these matters as one country.. I am afraid under the present situation we can not exist as one viable country. China and India have constructed thousands of dams.. Australia, USA have constructed thousands of dams... decisions for these matters are not taken under regional pressures.. whatever is good for the country over all has to be decided. Constitutions provide such provisions in every country where common interest of over all country is determined and such projects are undertaken.
It's disgusting that these common interest projects are used as hate politics without looking at the merits for over all economy of the country. If the water distribution formula is revisited.. Sind and Baluchistan can be the biggest beneficiary of this project. These decisions have to be taken trading maximum benefits with small consequences.. They are done in every progressive country of the world..

^ I agree with what ever you have written, but this issue has been muddled so much over the years that two provinces (KP and Sindh) have made it into a matter of life and death. I personally dont think that the dam is more important than the unity of the country. We can generate thousands of MWs of electricity through small hydel power plants, and try to minimize the loss of water by better management techniques. Besides big dams are ecological disaster. Many researches have been done on the topic.

Somebody went to the court that government is not implementing the CCI decision which is binding on them. Court just saw the legality of the petition.. And decided on merits. Rest of the matters are for the people-stake holders to decide..

Do you think this matter is that simple? That stupid, retard, could not see the other factors involved in this crucial matter which affect adversely to three provinces? This kind of mentality resulted in Bangladesh. That stupid judge should have realized that unless he thinks LHC is a Roman Empire and three provinces are slave provinces to Punjab, he could not have made this stupid decision. Shame on him on his colonial mentality.

The law says CCI decisions are binding unless they are modified by parliament ( not provincial assemblies).. Either modify the CCI decsion through parliament.. Or implement the decsion. The dam was given a go-ahead by the Planning Commission of Pakistan. The court only ordered that the Commission's orders should be implemented.

Unlike some people who don't understand anything are claiming that LHC has decided to build the dam. LHC has decided the case on purely technical aspect of the decision of CCI which is binding on the goverement unless parliament modifies the decision of the CCI.. Court has no job realizing anything or feeling anything.. They have to decide everything strictly as per the frame work provided to them by the law makers of this country.
P.S. Punjab LHC is a part pf federal judicial system and also decides according to frame work given by federal law makers..

Like yazdi mentioned that the court has given the verdict according to the law prevelant in the country, if PPP does not agree with that they can change the constitution or nullify the decision of CCI.
