I don't want to risk paying a lawyer I haven't met in Pakistan because what if they just give me some fake papers telling me that the divorce is finalized when I am still legally married? Thanks psyah, I will message Afshi.

1st thing first, call immigration and withdraw beneficiary visa process. Next, get with Muslim community, and let your situation know to them.

^ Good point. You have the option of withdrawing your sponsorship application at ANY time before the visa is issued. Do that first!
You entered into a legal contract with CIC when you sponsored your spouse. If he comes here and applies for support from the Canadian government among other things, you would be deemed to have violated your obligation under the said contract. This might impact your ability to sponsor someone else in the future.

I know a very good family lawyer who worked as a judge also on deputation. has his own practice of family cases. Above 55. Least greedy person. Extremely professional. Respected in the bars. Will charge you around 30 to 50k for Khula.
The law tilts towards women more in divorce / khula cases these days. Most judges favor women who don't want to live with husband....

Divorce/ Khulla For Overseas Pakistani:
If your marriage registered in Pakistan and you are not in the country and you want to get Divorce/ Khulla in Pakistan, you can do this without your presence in Pakistan. You shall appoint Special Power of Attorney who will work on your behalf. If any Pakistani woman who is not in Pakistan wants to get Khulla through Pakistani Court, her presence in the court is not essential, she will appoint special power of attorney who will appear before the court in her behalf. This is the way for overseas Pakistani to get Divorce/ Khulla without their presence in Pakistan.

If your husband has a marriage certificate from Pakistan, he can enforce it here in Canada. if there is not certificate (or one is lost), then you are pretty much unmarried in the eyes of law. You might even claim it to be a common law relationship, hence no divorce is necessary.

ayre can u not ask some lawyer in canada abt how to proceed? are there any women aid type organisation which can give you legal advice?
you need legitimate legal advice. and i wouldnt trust a lawyer off the internet who you dnt knw personally and cannot oversee. it can be anyone and you would lose money. do u have any family in pakistan who can oversee it for you?
also you shd stop the visa process asap. wish you best of luck and lots of prayers.

Khulla is also a form of divorce , which is made by mutual commitment of both members. but we talk about court then if ur shia muslim u cannot get the divorce from court as in shia sect do not believe on court divorce . 2nd if u,ve care about islamic laws then why if ur hubby cannot come to canada then why don't u shift in Pakistan. just for the sake of canada breaking relation is not wisdom .

Sorry to dig this topic up again...
My sister is going through a same situation. She is registerd as married in the uk ( only nikah has taken place and no rukhsati done yet). The inlaws of my sister are extremly greedy and changed their behaviour compared to when the nikah was done. The boy is still in pk.
My question is: would the divorce applied in uk be enough for the islamic talaak/khula?
And i have heard that the wife has to pay the ex husband to get khula... But what if the husband has already created so much debts for my sister? And never supported her, does she needs to pay him?
And what if the boy owns my sister money? (like borrowed from my sister ) can she claim that back?
How long would it take to get the divorce if it is applied from uk?..
A last fact is that when my sister made her Nadra Card, they hadn't changed her marrital status. She still is registerd as single... The card was applied 7 months after the nikah... Does this bring any changes? Owhjah another thing. The boys side has no nikah nama with them. All the copies are with my sister...
