I am not sure if i understand your question, but this is something that came up in a tv programe.

The famous or infamous scholar Mr Ghamidi, stated in his programme that Islam never claimed to be a complete code of life, this is a statement that has come up much later.

This reminded me of a Hadith about a companion who was sent to be ruler/amir of an area by Prophet pbuh and was asked how would you rule the people, he said by Quran, asked if you don't find a ruling in Quran, answered then i will look for it in Sunnah, asked, if not found in Sunnah then, answered, then i will do "Ijtihad".

Now i am not sure of exact "mutn" or content of Hadith but thats what it roughly is. (I wonder if somene could find it and write here).

Does this not mean that not every thing is described in Quran and Hadith and some things have been left to people's judgement? Now there is a vaklid counter-argument that Ijtihad is considered part of Islam. However, this is teh part that is not directly sent to us by Allah.
