Fuqaha do not have the right to be making things haram, they can provide guidelines for it to be liked or disliked. If it was so explicitly declared haram then why the need for the Fuqaha.
Allah SWT has explicitly made things haram for us and they are not doubtful. I always notice this that when quoting ahadith people quote only those ahadith that support their POV and neglect others that run contrary to their POV. My opinion has always been to study all the ahadith first related to a topic before forming an opinion about it.
If there is even one case in the ahadith where the Prophet SAW did not object to it (and there has been quoted as such) then you cannot make it say it is haram. It becomes incumbent that we further study the circumstances surrounding the ahadith.
