Should PAkistan sign and ratify the treaty establishing the ICC? What are your views regarding that?]
In brief: The Court will have the jurisdiction to try individuals who have comitted crimes of agression, were involved in genocide, war crimes, human rights abuses and who are or have been in positions of power. However, this can only be done once the superioir courts of the state fails to indict the person. The Courts jurisdiction is infact the bone of contention due to which the states (majority of those who have criminal elements at large) are hesitant to sign the treaty considering it a breach of sovereignty.
The question about sovereignty or loss of it in the age of globalization is another question altogether But seen from this angle also, once states have become part of this market economy, they know that their sovereignty and exclusive claim over it is at stake… I know it isn’t a very good analogy; acting upon the dictates of the Word Bank and IMF is one thing and handing over ones citizens is another. However,while the former deals in some ways with the loss of honor, the latter does have some humanitarian touch to it though..
