Fake degree holders are traitors, deserve 80 lashes: Afgan

ISLAMABAD: Former law minister and constitutional expert Sher Afgan Niazi has said a member of parliament having a fake degree not only faces disqualification but is also liable to be tried for committing high treason under Article 6 of the Constitution, awarded 80 lashes under the Islamic law for lying, and proceeded against under sections 420, 467 and 471 of the Pakistan Penal Code for defrauding the people.

Afgan told The News that the latest Supreme Court judgment on the issue of fake degrees, provided for punishment for three years, which in his opinion is the least and the most lenient view of the apex court. “The fake degree holders have also broken the oath of the Constitution as given in its Third Schedule,” he said, adding that while taking the oath of his membership, a MP commits that he would perform his functions honestly to the best of his ability, faithfully in accordance with the Constitution, law and the rules of the assembly.

He also commits that he would preserve, protect and defend the Constitution of the Islamic Republic of Pakistan. “Getting into parliament on the basis of a fake degree is a clear violation of the constitutional oath which amounts to a criminal offence and can be tried under Article 6 of the Constitution,” he said, arguing that the chief minister Balochistan has also violated his oath as member of the provincial assembly as well as the chief minister while ridiculing the Constitution and the law.

Under the Hadood laws, he said such offenders are liable to be punished under Qadaf Had because of their being non-truthful or being liar. A liar is awarded 80 lashes under the Hadood Laws, Afgan explained.

A parliamentarian with fake degree, he said, also proves that he is neither sagacious and righteous nor honest and Ameen as is the requirement of Article 62(f) of the Constitution dealing with the qualifications of the members of parliament.

He said under the election laws, the nomination forms are signed by the proposer, seconder and the candidate on solemn affirmation and with the declaration that the candidate fulfils the qualification specified in Article 62 and is not subject to any of the disqualification as specified in Article 63 and any other law enforced for being elected as member of parliament.

The nomination papers, he said, are personally submitted by the candidate to the returning officer and once these papers are submitted they become a public document. Since the nomination papers of a candidate become property of the public, therefore, he explained, any mis-declaration becomes violation of PPC sections 420, 467 and 471, which deals with cheating, breach of trust and forgery in the official documents. “It also violates PPC 406 that talks of breach of trust,” Afgan said.

Referring to the Representation of People’s Act of 1996 and the rules made thereunder, he said the nomination papers also include a declaration and oath by the person nominated (candidate), who commits that he fulfills the qualifications specified in the Article 62 of the Constitution and is not subject to any of the disqualifications specified in Article 63 of the Constitution or any other law for the time being enforced for being elected as member of the National Assembly/provincial assembly.

Referring to the Chapter IX of the Representation of People’s Act 1976, he said a person shall not be qualified to be elected or chosen as a member of an assembly if he is not a graduate from an institution recognised by the Higher Education Commission (HEC). In Sher Afgan’s view, the holders of fake degree deserve much serious punishment as compare to the one suggested by the apex court in its recent judgment.

And in reality the MPA/MNA resigns from the seat becomes PM/CM/President’s advisor, gets nominated in the by-elections again and comes back to the assembly, way to go Gillani/Sharif logo !

Balochistan Chief Minister Nawab Muhammad Aslam Raisani said that a degree is a degree whether authentic or fake. “Raisani” are one of the largest feudal and a tribe having “unique innovative ideas, philosophies”. Raisani sardars teach their children abroad, keep their money abroad in order to serve Balochs in Pakistan much better. Like Nawab Aslam Raisani’s statement on degrees made all of a sudden popular internationally recently another Raisani got international fame in the diplomatic circles. Within 5 months of his appointment as Pakistan Ambassador to Syria he recruited almost his entire family in Pakistan International School Damascus replacing the old staff and thus arranging a monthly earning of Rs. 3.2 million for the family. When the Chief Justice of Pakistan took suo moto notice of this, this Raisani produced in the court a letter purportedly written by the Chairman of the School Board of Governors Mr. Gaith Pharoan addressed to the Editor-in-Chief of a Pakistani newspaper praising the excellent services of the “Raisaini” for the school. The Chairman Gaith Pharoan however disclaimed this letter. Mr. Gaith Pharon is a Saudi who has invested billions of dollars in Pakistan like he owns Pakistan’s most famous Attcok Oil Company. During President Zardari’s February 2010 visit to Syrian as a sign of love for Pakistan Gaith R Pheraon agreed to bear major share for construction of an international standard mega Benazir Bhutto Auditorium in Damascus. He has now resigned as Chairman of School Board clearly wording in his resignation letter about the nepotism and favouritism by Ambassador Raisani adding the word till you Mr. Raisani “leave” Syria. A real honour and a unique innovative “gift” the word “you leave” for Pakistan.

A degree is a degree whether true or fake is an innovative tribal thinking and ideology. I am sure under the same philosophy and the innovative ideological principles, if a girl gives birth of an illegitimate child in the “Raisani Tribe”, it would be a "Raisani" son/daughter of the father/mother whether out of Shariah compliant marriage or through extra curicurm vita and not a “Kora kori” case.

The politician is right....What has leadership got to do with degree???? Does Michael Dell have a degree, Bill gates, henry ford....Degree is just a piece of paper...and so is toilet paper....

Here is true dictionary definition of educated person.

An educated person is not necessarily one who has an abundance of general or specialized knowledge. Educated people have developed the faculties of their minds so that they may acquire anything they want, or its equivalent, without violating the rights of others.

College education just teaches a person to solve problems........you can find these problem solvers dime a dozen, even in the gutters of any city of the world...

Its only problem identifiers that make a mark in this world. And for that you need to be educated man who has capacity to develop from within not a guy with a piece of paper...

Education minister does not see fake degrees as ‘big crime’

ISLAMABAD: Federal Minister for Education Sardar Aseff Ahmed Ali does not see fake degrees as a big crime and said that the cost of fake degrees should not be the ineligibility of the people elected representatives.

“The compensation of some crime should be equal to the nature of that crime and the same applies to the case of fake degrees where the public representatives should not be sent back home merely on the basis of this small mistake,” said Ali.

While addressing to a press conference on Thursday, he said that currently the country was not in the position of holding mid-term elections and such decisions should be taken in the larger interest of public. “We have already witnessed that people of Pakistan have elected the same contestants, who have been declared ineligible by the court for holding fake degrees,” he said.

He said that it was rather the Election Commission of Pakistan (ECP), which was responsible for scrutinising the nomination papers of all the contestants. “Why haven’t they scrutinised the documents properly when they were submitted to returning officer?” he asked. He said that the entire burden had been put on the people who have public mandate,but those who are actually responsible have not been inquired about.

“Why not the returning officer is inquired? They have 10 to 12 days to scrutinise the documents and then two or three days for objections,’ he said while adding that previously there was Election tribunal, who was responsible for taking up such issues.

Khan said that there were many fake degree holders in the cabinet during five year Musharaff regime, but neither media nor judiciary raised their voice against it. “There is no harm in being careful and Supreme Court should have been more careful in taking up this issue,” he said.

He said that he had great respect for judiciary rather he was the one, who got injured for the free judiciary. “We are 99 per cent implementing the orders of the judiciary, as we have great respect for them,” he said.

Moreover Advisor to Prime Minister on Social Sector Shahnaz Wazir Ali said that there was no pressure by government on Higher Education Commission (HEC) over the issue of fake degrees. “HEC was doing its job in transparent way while facing no pressure or hurdle from government side,” she said.

The whole degree issue is bogus. Dictator mushy..one day decided that all the elected officials should have degrees..and its a law? 50%+ of the awaam is illiterate, they have no right to represent themselves?? Lets make another rule..if ur fat , have mustache and ganja u can not run for office. This will disqualify the 80% of the politician. What a BS, really!

In that case India should shut down all schools and universities :k:
