No, its not str8forward. Because in the hadith - the child goes to his mother when both parents call her. But then when the Prophet beseeched God, then the child when to her father.
So we're supposed to sit the kid in front of a neutral party that prays something and see where the child goes??
pyaagudia i don't know if you are being sarcastic but its straightforward because the kid is old enough to decide. The prophet(pbuh) is the best of judges he knew wat was best for the child the child chose mother first then prophet said may allah guide her and then she changed her mind simple as that, she could have not changed her mind but she did.

pyargudia to be honest i dont even know why you bothered to ask question in the first place you asked for answer you got it, then you asked for hadith you got it, its straightforward but you say it is rubbish well that is your choice to call it rubbish i am perfectly happy 100% with what muhammad(pbuh) decided in this matter.
people should ask themselves before asking a question that are they going to accept the solution even though they are incapable of understanding or liking it.

This doesn't look like a genuine question from the conclusion you've jumped to.
You can't approach this with a western perspective on life. The mother has custody first and after a certain age, (since it is also the child's responsibility to look after the parent) the child decides who he/she wants to look after. It's not the case that the child can't see the other parent, no one can stop the child from visiting either parent or stop the parent seeing the child.
In all cases of poverty if the mother can't afford to look after the child then the state pays benefits, enough to look after both of them if need be.
You can't appreciate the justice of Islam without it being implemented at the state level.
