Is PPP trying to protect Musharraf?

ISLAMABAD: A PPP minister has been going around meeting some of the deposed judges in Islamabad’s Judges Enclave to seek assurances that once restored they would not re-open cases against President Musharraf, it is learnt.

A source said the minister met some of the deposed judges three days ago and proposed only one condition for their restoration: they would not re-open cases against the man at the top. In his individual meetings with these judges, the source said, the minister told each judge he had met other judges who, he claimed, had agreed to the condition.

But later when some of the judges consulted each other at a get-together, the source said, it was revealed that the minister was just bluffing. All this was happening amid reports of concerted efforts to disrupt the historic Murree Declaration. Some PPP stalwarts are said to have become part of this game plan to offset the PPP commitment to restore judges through a resolution in the National Assembly.

The scheme is to block the restoration of deposed Chief Justice Iftikhar Muhammad Chaudhry by resorting to a constitutional package which, if adopted, would result in the dismissal of all the superior court judges and their reappointment after scrutiny and confirmation by a parliamentary body.

Under the garb of giving sovereignty to parliament, the effort is to negate the mandate of the people for restoration of deposed judges as on Nov 2. However, the author of this strange game plan has conveniently overlooked the basic point that if scrutiny of sitting judges by a parliamentary body is accepted as a prerequisite for their restoration then every judge would become controversial.

“Skeletons would be brought out of every cupboard of every judge by lawyers, civil society members, media and others,” a source said, adding such a recipe would not allow even the government to retain judges of its choice. Supreme Court Bar Association president Aitzaz Ahsan has already started warning about such a conspiracy.

When contacted he said the latest conspiracy had been hatched by the presidential camp. It offers a Constitutional package, which would restore all judges but at the same time require the re-appointment of all sitting judges after a review de novo by a parliamentary committee of both the houses of parliament.

Aitzaz said in this process the presidency believes that it would be able to get rid of Chief Justice Iftikhar Muhammad Chaudhry by making him controversial before the committee.

President’s Spokesman Maj-Gen (retd) Rashid Qureshi, when contacted, denied that President Musharraf is behind any such conspiracy. Qureshi said Aitzaz is and has been unfair to the president, about whom he has become paranoid.

He said he does not want to comment on what Aitzaz Ahsan says about Musharraf. Another leading lawyer Justice (retd) Tariq Mehmud is already quoted in The News saying a top PPP legal mind had discussed with him what was called the “Minus-One Formula”.

Tariq had also said the PPP legal aide had also tried to convince him that the new PPP government would feel more comfortable with Chief Justice Abdul Hameed Dogar instead of Iftikhar Muhammad Chaudhry.

He was trying to convince me to approach Justice Iftikhar so that he should give a guarantee that after his restoration he would immediately resign from the office of the chief justice on the very first day,” the newspaper quoted him as saying.

The same report dated March 25 also carried a denial by Farooq H Naik, now law minister, to have said any such thing. Naik, however, told The News correspondent Usman Mansoor on Thursday that a government committee and parliament would finally decide if the judges would be restored through a resolution or a constitutional amendment.

He said names of the committee members as decided by the cabinet to finalise modalities of the restoration of sacked judges have been submitted to the prime minister but it has not yet been approved.

He said he could not divulge names unless they are approved by the prime minister. He had recommended the constitution of the committee a day after the first cabinet meeting. He explained that it would be up to the committee to decide whether sacked judges would be restored through a parliamentary resolution or through a constitutional amendment.

He, however, insisted that the final decision would be taken by parliament, which was the supreme institution for legislation. This statement of the law minister is in complete contrast to the Murree Declaration, signed by Asif Ali Zardari and Nawaz Sharif, which clearly said that the restoration of the deposed judges would be done through a national assembly resolution.

Another top legal mind of the PPP Sardar Latif Khosa, too, has been expressing his views that the constitutional changes made by President Musharraf through his PCOs are now part of the constitution.

In Geo TV talkshow, Capitaltalk, he had said the Constitution stands amended after the Nov 3 PCOs. This viewpoint of Khosa is contrary to the political stance of the party and its allies that the right to amend the Constitution is solely with parliament.

On the very first day of the new assembly, before talking the oath it was PPP’s Naveed Qamar, who had clearly said that they do not accept the PCO-amended Constitution and would therefore take oath under the Constitution as it was on Nov 2, 2007.

A column written by another PPP legal mind, Babar Awan, which appeared in daily Jang of April 2, also raised many eyebrows as the writing was construed as part of a campaign against deposed Chief Justice Iftikhar Muhammad Chaudhry.

Asif Ali Zardari, however, has said more than once that he is committed to the Murree Declaration. During his recent joint press conference with Nawaz Sharif at Raiwind, he said the Murree Declaration is quite clear, adding the judges’ restoration issue is not a complicated matter as presented by different circles.

But at the same time there are some who apprehend whether Asif Ali Zardari is serious about what he is publicly claiming or has something else up his sleeves and whether he is going to give legal cover to the illegal and unconstitutional acts of President Musharraf.

Meanwhile, it is interesting to note that despite the fact that the new government is in place, almost all key appointments, including that of attorney-general, the law secretary and key intelligence officers, who have been playing important role during the judicial crisis to the benefit of President Musharraf have remained unchanged.

The interior secretary, who was one of the prime witnesses against deposed chief justice Iftikhar Muhammad Chaudhry in the Presidential reference filed on March 9, 2007, is still untouched despite being a retired bureaucrat who was re-hired on contract.

Asif ticks off Aitzaz

NAUDERO: PPP Co-chairman Asif Zardari is reported to have ticked off Aitzaz Ahsan in an after-dinner gathering of the PPP’s Central Executive Committee (CEC) members in Naudero on the subject of the restoration of the judges, independence of the judiciary and the threatened long march by Aitzaz and his supporters. According to sources present on the occasion, Zardari took Aitzaz to task for constantly threatening to launch a long march to force parliament to restore Iftikhar Mohammad Chaudhry and the other deposed judges. Zardari advised Aitzaz to go ahead with his long march if he was so keen on it instead of constantly threatening the PPP about it. He told Aitzaz that he was wrong to think that the lawyers movement had forced General Pervez Musharraf to take off his uniform or hold the elections. He said that honour belonged to Benazir Bhutto who had compelled Musharraf to do so and paid for it with her life. He said the entire credit for restoration of democracy went to Ms Bhutto and Aitzaz and the judges and lawyers could not rob her of her victory. Zardari also reminded Aitzaz that while he was incarcerated for eight long years none of these heroic judges had given him justice, even when he had asked for one day’s reprieve to attend a funeral of a close relative. Zardari is reported to have said that Justice Chaudhry had politicised himself overtly and ruined his case as an advocate for an independent judiciary. He also cited other instances when some of these judges had not conducted themselves with any degree of integrity or independence in the past. Judges’ scrutiny by parliament panel after reinstatement

ISLAMABAD, April 3: A draft constitutional package envisages subjecting all judges of the superior judiciary to scrutiny by a parliamentary committee after reinstatement of the judges sent home upon proclamation of the emergency on Nov 3. According to a reliable source, the government had “almost finalised” the “omnibus” constitutional amendment package. “The constitutional package, being finalised with the consent of all the allied parties in the coalition government, is getting the final touches,” the source said.

The proposal is in conflict with the Murree declaration, signed by the People’s Party and the Pakistan Muslim League-N last month, that spoke about the judges’ reinstatement through a parliamentary resolution within 30 days of government formation at the centre. “Now the judges would be reinstated first in respect of the commitment made, but then the case of every judge, including the deposed and the incumbent, would be reviewed by a parliamentary committee to make a decision about their retention in the superior judiciary,” the source said.

The President of Supreme Court Bar Association, Barrister Aitzaz Ahsan, has already warned political parties against giving their assent to a package “prepared by the presidency”. The package is the brainchild of Attorney General Malik Mohammad Qayyum, Aitzaz Ahsan has alleged. He said President Pervez Musharraf wanted to make Justice Iftikhar Chaudhry very controversial so that he could be removed after the scrutiny process. Any such attempt would open a Pandora’s Box, he said, adding that every judge would then become controversial and the entire judiciary would be thrown into turmoil. Former SCBA president Hamid Khan was also critical of the package, recalling that the Murree declaration only suggested en bloc reinstatement of all those judges who refused to take oath under the PCO. He suggested that the draft copy of any constitutional package should be circulated among bar councils and associations. About Justice Iftikhar, Hamid Khan alleged that conspiracies were being hatched to get rid of him. He, however, warned that any proposal that spoke of reinstating judges minus Justice Iftikhar would not be accepted by the legal fraternity.

SAHIWAL (Online) - PPP Co-Chairman Asif Ali Zardari on Monday said despite the fact that conspiracies were being hatched to create difference in the coalition on the issue of restoration of deposed judges, they were steadfast on their stance in this regard.
Co-Chairman PPP Asif Ali Zardari expressed these views while talking to a delegation here on Monday.
He said that PPP attached top priority to the service of people and did not believe in political vendetta.
“We are united on our stance, despite the fact that some people are trying to create differences in judges issue,” he added.
He reaffirmed his commitment to reinstate the deposed judges, including deposed Chief Justice Iftikhar Muhammad Chaudhry.
Undoubtedly, the PPP would complete the unfinished mission of Benazir Bhutto and Zulfikar Ali Bhutto, he said.

PML-N conveys reservations to Gilani, Zardari

The PML-N has conveyed to the PPP its serious reservations against the proposed formation of a parliamentary committee to formulate recommendations for the restoration of deposed judges. This would amount to further complicating the issue, a prominent PML-N leader, who is also a federal minister, told The News. The PML-N has directly articulated its reservations to Prime Minister Syed Yousuf Raza Gilani and will communicate them to the PPP Co-chairman Asif Zardari when he returns to Pakistan from Dubai, the cabinet member said. Law Minister Farooq H Naik reiterated on Monday that a parliamentary committee of the ruling coalition parties would be constituted to compile recommendations for the resolution of deposed judges that would be tabled in parliament.

ìThe parliament will have to take the decision on the issue of judiciary that will be resolved according to the aspirations of the masses, Naik said. The PML-N minister said as repeated by his party several times that the restoration of the deposed judges was a simple issue that should not be complicated unnecessarily. He feared that establishment of a parliamentary committee, as pressed by the law minister, has the potential of marring the PML-Nís relations with the PPP. Neither we nor the PPP want such a dismal scenario to crop up at the very outset, he said. The minister said since the judges were sacked through illegal and unconstitutional measures, they needed to be brought back through an executive order. Such a directive, he said, can be issued right away after the passage of a parliamentary resolution. The judgesí issue has been the PML-N’s main plank of politics since long. It knows that it would massively damage itself if it backs out on the restoration of justice and has no doubt that it would gain politically if it continued to push for restoration of the judges.

The PML-N sees an easy and smooth ouster of Pervez Musharraf from the Aiwan-e-Sadr in the reinstatement of the judges, he said. As far as the presidency is concerned, it is closely watching the activities of the ruling coalition partners on the fate of the deposed judges. We have no agreement with the PPP or any other parliamentary party on the question of restoring the deposed judges, but we have no doubt that they can be reinstated only through a constitutional amendment to be passed through a two-thirds majority in the Parliament, a presidential confidant told this correspondent. He said it appears from the newspaper reports that the government is preparing a legal formula to determine how to appoint judges, how to ensure that there was no clash between parliament and the superior court judges in future and non-partisan people sit as judges so that the practice of believing that ìthis is my judge and this is not my judgeî is buried for ever. Reports also said, the confidant pointed out that, all these elements would be part of a constitutional package the government was apparently preparing.
