Balochistan Mutahidda Mahaz has announced to hold Mustehqam Pakistan rally on April 28 and Mustehqam Pakistan public meeting on April 29 in Quetta. During a press conference at the Sarawan House in Quetta, Nawabzada Mir Siraj Raisani said we don’t need a certificate from any quarter to be considered as Pakistan citizens. He said that there may be differences with authorities but not with the nation. He also demanded bring back Nawab of Qalat and other angry Baloch leaders and resolve their concerns.

**THE attention the Supreme Court (SC) has focused on the Balochistan conflict and the human rights abuses being committed there raised the expectations of the affected population.
**
But after Chief Justice Iftikhar Chaudhry departed from Quetta, (the hearing, headed by the chief justice, over law and order in Balochistan resumed on Monday in Quetta) a few weeks back the situation soon reverted to the status quo. Since then, more mutilated bodies of Baloch activists have been recovered. Many activists have reportedly been ‘abducted’.

The piecemeal nature of the SC’s approach is neither helping victims nor discouraging the violators of human rights from curtailing what appears to be a policy to eliminate moderate Baloch activists under the pretext of counter-insurgency efforts.

The apex court in the federal system has, in this regard, two sets of responsibilities: first, to ensure the provision of fundamental rights and restrain dominant ethnic groups from abusing the rights of non-core groups, and secondly, to guarantee the full implementation of the constitution with regard to the political and economic rights of the federating units and check the systematic exploitation of groups and individuals.

**Sadly for Pakistan, the role played by the apex as well as the high courts in terms of conflict prevention and resolution has been disappointing. In order to prevent further political and human catastrophes, this forum ought to immediately order a comprehensive and impartial inquiry with regard to Balochistan’s political, economic, security and human rights’ complexities.
**
The inquiry should focus on examining the role of the central government and law-enforcement agencies in Balochistan, and their involvement in the way decisions were made by the Musharraf-led and subsequent governments.

**The decisions made and actions taken between 2004 and now must be looked into to establish as accurately and reliably as possible where things went wrong and what lessons must be learnt.
**
**If an inquiry could be conducted impartially and free from the influence of institutions notorious for interfering, it could provide a reliable account of the events that drove matters to the current pass.
**
**This would identify lessons helpful in guiding federal-provincial relations, addressing social and economic disparities, reducing ethnic prejudice and instituting security-sector reforms that are not ethnically biased. There would be the further potential of defining conflict prevention and resolution mechanisms.
**
**This is without doubt a challenging task. Should the SC be able to make a bold decision, though, what the country stands to gain is the restoration of the trust of marginalised ethnic communities, and the restoration of rights to the people that have been devastated by discriminatory policies and state structures that are imbalanced in terms of ethnicity.
**
**The judicial inquiry constituted by the SC should provide a reliable account of the nearly eight-year-long and continuing conflict in Balochistan. A Balochistan inquiry committee could take matters further and ask national and international experts and advisers to assist in its work of asking the questions that need to be asked to establish the truth, resolve the situation and prevent it in the future.
**
The stakeholders to be called on would include Baloch nationalist parties, victims of enforced disappearances, the family members of ‘kill and dump’ victims, journalists, Baloch leaders here and in exile, and Baloch writers and intellectuals.

From the side of the state, respondents would include former and current federal government representatives, former and current heads of the Frontier Corps, representatives of the intelligence agencies and all other actors that were involved in Musharraf’s deadly policy vis-à-vis Balochistan.

**Everything would hinge, though, on witnesses’ ability to speak freely and provide truthful, fair and accurate evidences and assessments. Matters could be improved if the government extended immunity from disciplinary action to serving official and military and paramilitary officials who give evidence to or otherwise assist the inquiry committee.
**
It is possible — indeed, likely — that the issues raised will include political, economic and development dimensions. However, all these fields are intertwined and central to the ongoing conflict. An example is the role played by the Ministry of Petroleum and Natural Resources, or the Oil and Gas Development Corporation, which are earning billions of rupees a year from the wells of Dera Bugti. Meanwhile, the government must ensure full cooperation with the inquiry committee by committing that no document or witness lies beyond the scope of the forum — including reports by the intelligence agencies and top military commanders’ decisions that led to the endless blood-letting.

Furthermore, the state must make sure that the inquiry committee has all the resources it needs to properly fulfil its mandate.

The latter must reciprocate by making sure it functions efficiently and does not waste public money.

There would be a great deal of interest in how the inquiry committee conducts its business, particularly in how it ensures fairness to witnesses whilst making sure that it is able to elicit a full, accurate and truthful account of the military operation in Balochistan.

To have credibility, though, the inquiry must be transparent about its approach and the processes it adopts. All the citizens of the country have a right to know what underpins the conflict and what its destructive consequences have been.

Accounts of the hearings and copies of all the documents submitted should be put on the Internet, and the media must have full access to the hearings.

Arrangements should be made for both the media and the public for the public evidence sessions. This would help increase public understanding and reduce the chances of further misadventures.

**Balochistan has suffered immensely in the past six decades. It is time to redress the grievances and end systematic oppression and exploitation through a genuine and credible process. Genuine peace — one that is not enforced through the security apparatus — will produce an assortment of positive outcomes.
**

**KHUZDAR: Federal Interior Minister Rehman Malik has said that measures were being taken to ensure an end to dumping of decomposed bodies within a week in Balochistan.
**
He was addressing inaugural ceremony of Passport Office Khuzdar here on Friday. “The government is going to contact with Baloch leaders including Brahmdagh Bugti, Hairbiar Marri and Sardar Akhtar Mengal to initiate peace talks with them in order to normalise the situation in the province,” he said adding that steps afoot to recover missing persons.

He invited Baloch youth to leave mountains and come to dialogue table to put their province on track of progress and prosperity.

He said that no military operation was being carried out in Balochistan. He appreciated Chief Justice of Pakistan Iftikhar Muhammad Chaudhry for conducting hearing into the cases relating to missing persons adding that the apex court’s step would help in resolving the issue.

He said that next meeting of the federal government on Aghaz-i-Haqooq-i-Balochistan Package would be held in Khuzdar adding that Balochistan had been given full control on its natural resources and the Gwadar port.

He said that Frontier Corps were deployed in different areas of the province in order to maintain law and order and to provide security and protection to life and property of people.

He announced establishing a university complex in Khuzdar, operation of weekly two flights of Pakistan International Airline (PIA) from Khuzdar airport. He also announced Rs 10 million for development projects of Khuzdar and 10 vehicles for police and Levies Force. He directed law enforcement agencies to launch operation against illegal vehicles in Khuzdar.

Earlier, Member National Assembly Muhammad Usman Advocate and Commissioner Kalat division Mir Akhtiar Khan Bangulzai accorded a warm welcome to the interior minister.

The people have pinned a lot of hopes on the courts now, if the people especially of the ‘neglected areas’ get the confidence that their grievances make an impact and that they will get justice that would go along way. The CM & federal government dont seem interested in having this issue solved.

**QUETTA: The Supreme Court, hearing a petition on the law and order situation and human rights violations in Balochistan, observed on Friday that the prime minister, federal ministers for interior and defence and the provincial government appeared to be not serious about resolving the issue of missing persons.
**
**A three-judge bench comprising Chief Justice Iftikhar Mohammad Chaudhry, Justice Khilji Arif Hussain and Justice Tariq Pervez regretted that summons had been issued to the Balochistan chief minister and home minister, but none of them appeared before the court.
**
**The chief justice said the chief minister was not taking any interest in the affairs of the province and, therefore, the court would ask the governor to play his role in restoring peace in the province.
**
The court said the interior minister and other government authorities used to issue statements in the media on the grievances of Balochistan, but in fact they were not serious about taking practical steps to recover the missing persons, provide security and protect the life and property of citizens.

“Balochistan police know everything about the missing persons, but they are neither ready to share information with the court nor do they want to take steps to recover them,” the bench observed.

**The court ordered registration of cases against two serving majors of the Frontier Corps in connection with the kidnapping of one Ali Hasan Mengal from Khuzdar.
**
**The weeping mother of 13-year-old Shabbir Samalani informed the court that her son had been missing for four years. She requested the judges not to leave for Islamabad till the recovery of her son.
**
**Justice Tariq Pervez said: “A grieved mother is weeping in the court; I am astonished why stones are not falling from sky. The cry of a mother for justice can bring punishment from God to the responsible persons.”
**
The chief justice said: “We have no interest in the case of a person belonging to the elite class, but in the case of a grieved mother because a mother cannot tell a lie.”

He said police were hiding truth from the court, but “we will proceed to Islamabad with the file of Shabbir”. He ordered police to recover the boy who reportedly went missing from the Brewery police station in Quetta.

**“The police after arresting the boy as target killer have handed him over to a secret agency and they are now avoiding telling the court which intelligence agency has custody of the boy,” the CJP said.
**
He gave police two weeks to recover lawyer Munir Mirwani who had disappeared from Khuzdar.

He said the court would summon the defence secretary, along with relevant records. The secretary will be bound to ask the heads of relevant institutions who will take responsibility for the deteriorating law and order.

**The CJP asked FC Balochistan’s DIG Brigadier Shehzad why people were being kidnapped in the presence of his force. He was told to convey to the FC inspector general the court’s order for early recovery of the missing persons.
**
The FC DIG said resources to work on the issue were not adequate. He suggested the setting up of a joint team of civilian and non-civilian institutions to trace the missing persons.

**Deputy Attorney General Malik Sikandar informed the court that the sector in-charge of Inter-Services Intelligence (ISI) could not appear because he was not in Quetta. The CJP asked him when the Balochistan IG could come to the court why not the sector in-charge of ISI.
**
**“The Supreme Court bench is not sitting in Quetta to listen to stories from the authorities,” he said, adding that the province was burning and stakeholders would have to play their role in putting out the fire.
**
**The families of seven persons who disappeared from Marwar area informed the bench that three of them had reached home. The remaining four are still missing. When the CJP asked who had picked up theses persons, they said FC personnel had taken them away from their homes. He ordered the FC to recover the four.
**
The CJP asked the provincial government to immediately release the salary of Dr Akbar Marri, one of the missing persons, to his family.
The chief justice sought a report on missing person Zakir Majid when law-enforcement officials informed the court in camera that he was wanted in cases of heinous crimes.

He said the FC IG would have to appear before the apex court in Islamabad if three people who had disappeared from Zarghoon Road area in Quetta were not recovered till Friday evening.

The court asked Home Secretary Naseebullah Bazai what steps had been taken against the kidnappers of judges. The CJP regretted that people were being forced to set up camps to collect money to pay ransom to the kidnappers to get their beloved ones freed.

The chief justice asked the home secretary what action had been taken on the home minister’s statement about the involvement of some ministers in kidnapping for ransom. The secretary said he had asked the minister several times to tell him the names of these ministers but he had refused to do so.

Chief Justice Iftikhar said police and the FC should conduct a joint operation to abolish camps set up for receiving ransom. “The apex court will extend all support to the forces in this regard,” he said.

All possible steps should be taken to end target killings and bring the elements involved to justice.

**Relatives of another 60 missing persons submitted their applications to the court.

The next hearing of the case will be held in Islamabad after two weeks.

Yes, quite. They were all pointing the finger at so-called security agencies.

If everbody is blatantly pointing at them, why isn't something being done about it or why aren't the agency representatives clarifying their position.

Why are the 'security agencies' so secretive that nobody hears from or sees them on media ever ?

Is the incompetent government doing anything else right that they would do something about this ?
